1. Purpose of an Advance Contract Notice (ACAN)
An Advance Contract Award Notice (ACAN) allows department and
agencies to post a notice, for no less than fifteen (15)
calendar days, indicating to the supplier community that it
intends to award a goods, service or construction contract to a
pre-identified supplier. If no other supplier submits, on or
before the closing date, a Statement of Capabilities that meets
the requirements set out in the ACAN, the contracting authority
may then proceed with the award. However, should a Statement of
Capabilities be found to meet the requirements set out in the
ACAN, then the contracting officer will proceed to a full
tendering process.
2. Definition of requirements and sole source justification
The Prairie and Northern Air Quality Science Unit of the
Department of Environment Canada has a requirement for the
supply and delivery of 2 Tekran Continuous Mercury Vapour
Analyzers Model 2537X.
Environment Canada currently has three continuous mercury
analyzers in three different locations throughout Alberta and
Manitoba. By the end of 2013-2014, Environment Canada will be
monitoring for Total Gaseous Mercury (TGM) at four different
sites (3 in the Alberta Oilsands region and 1 in Flin Flon,
Manitoba). The Oilsands monitors will be used as part of the
Joint Canada-Alberta Oilsands Monitoring Plan. All four sites
will be using the Tekran 2537 gaseous mercury systems to monitor
for mercury. The two new units will be integrated into the
current AQSU mercury monitoring network.
In order to maintain consistency with PNR-AQSU's current
monitoring and the Joint Canada-Alberta Oilsands Monitoring
Plan, it is important that these new analyzers are compatible
with the current system and will not result in additional
training and maintenance costs.
2.1 Minimum Essential Requirements
Any interested supplier must demonstrate by way of a statement
of capabilities that its product meets the following
specifications:
Must measure total gaseous mercury continuously.
Must be capable of unattended operation for at least six
continuous weeks at a time.
Must be able to reliably quantify mercury down to 1 ng/m3 or
lower, with a documented method detection limit of 0.7 ng/m3 or
lower.
Must output the data through a serial port at 2400 baud or
greater; to be logged on a Windows PC for archiving and for
remote data access and download by modem. Any software that is
required for the analyzer to log data on a PC is part of the
required package. The PC and modem are not part of the required
package.
Design must not rely on transporting reactive mercury along
sample lines as that would result in sample loss.
Must be compatible with the Envidas data acquisition system.
Must have an Internal permeation source capable of daily
automatic calibrations.
The analyzer must be compatible with the existing the Tekran
1130/1135 Speciated mercury monitoring system.
The product is to be delivered by August 30th, 2013 to Edmonton,
AB.

4. Government Contracts Regulations Exception
This contract is subject to subsection 6 (d) of the Government
Contracts Regulations, in that only one person or company is
capable of performing the contract.

8. Submission of Statement of Capabilities by Suppliers
Suppliers who consider themselves fully qualified and available
to provide the services/goods described herein, may submit a
statement of capabilities in writing to the contact person
identified in this Notice on or before the closing date of this
Notice. The statement of capabilities must clearly demonstrate
how the supplier meets the advertised requirements.
The PWGSC file number, the contracting officers name and the
closing date of the ACAN must appear on the outside of the
envelope in block letters or, in the case of a facsimile
transmission, on the covering page.
The Crown retains the right to negotiate with suppliers on any
procurement. Documents may be submitted in either official
language of Canada.
