Nature of Requirements:
1. Advance Contract Award Notice (ACAN)

An ACAN is a public notice indicating to the supplier community

goods, services or construction to a pre-identified supplier,
thereby allowing other suppliers to signal their interest in
bidding, by submitting a statement of capabilities. If no
supplier submits a statement of capabilities that meets the
requirements set out in the ACAN, on or before the closing date
stated in the ACAN, the contracting officer may then proceed
with the award to the pre-identified supplier.

2. Definition of the requirement

Agriculture and Agri-food Canada has a requirement for an
automated macro determinator for carbon, nitrogen and sulfur for
the Soils and Crops Research and Development Centre in Quebec
City. The contract also provides for the training of three
users. Delivery must be made to Quebec City, Quebec, no later
than March 31, 2016.

3. Criteria for assessment of the Statement of Capabilities

Any interested supplier must demonstrate by way of a statement
of capabilities that its system meets the following requirements:

The instrument required is the only one on the market that is
automated and capable of simultaneously determining carbon,
nitrogen and sulfur contents in soil and plant tissue in less
than five minutes. The macro determinator must be equipped with
a horizontal ceramic furnace capable of reaching a temperature
of up to 1450 °C, thereby ensuring complete conversion of the
sulfur in a 100% oxygen environment. The new instrument must be
able to accommodate microsamples of up to 3 g and thus provide
more representative results for each sample.

4. Applicability of the trade agreement(s) to the procurement

This procurement is subject to the following trade agreements:

Agreement on Internal Trade (AIT)
North American Free Trade Agreement (NAFTA)

5. Justification for the Pre-Identified Supplier

The only known supplier of macro determinators for carbon,
nitrogen and sulfur that meets all required technical
specifications is the TruMac CNS from Leco. For this reason, it
is proposed to negotiate this requirement with the Canadian
distributor of the original equipment manufacturer, namely Leco
Instruments ULC.
