1. PURPOSE AND EXPLANATION OF AN ADVANCED CONTRACT AWARD
NOTIFICATION (ACAN):

An Advanced Contract Award Notice (ACAN) is a public notice
indicating to the supplier community that a department or agency
intends to award a contract for goods, services or construction
to a pre-identified supplier, thereby allowing other suppliers
to signal their interest in bidding, by submitting a statement
of capabilities. If no supplier submits a statement of
capabilities that meets the requirements set out in the ACAN, on
or before the closing date stated in the ACAN, the contracting
officer may then proceed with the award.

2. REQUIREMENT:

Regional Individual Standing Offer (RISO) for the supply and
delivery of submersible Argos beacons to the Department of
Fisheries and Oceans (DFO), Institute of Ocean Sciences (IOS),
Sidney, BC Canada V8L 4B2 on an "as and when requested" basis.

Description of requirement and estimated yearly usage:

Self-contained submersible ARGOS Beacon - Xeos Model XMA-7500
Supplied units must support all of the following mandatory
requirements:
a. All mechanical components must be made of titanium to
prevent corrosion in seawater;
b. Must be equipped with capacitance activated switch to
support use in shallow waters of 15m or less;
c. Must support in-the-field, user-selectable identification
and repetition rate for hailing to prevent interference from
closely located beacons;
d. Must support in-the-field, user-selectable transmission
frequency channels between range of 401.63 and 401.69 MHz, again
to allow flexibility to prevent interference from closely
located beacons.

Estimated Yearly Usage: 20 each

3. TRADE AGREEMENTS:

The requirement is subject to the provisions of the Agreement on
Internal Trade (AIT).

4. GOVERNMENT CONTRACT REGULATIONS EXCEPTION AND LIMITED
TENDERING REASONS:

Sole-sourcing under the Government Contracting Regulations
(GCRs) is supported by the following: Part 1, Section 6(d)
"only one person or firm is capable of performing the contract".

Sole-sourcing under the Agreement on Internal Trade (AIT) is
supported by the following: Article 506, Section 12(b) "where
there is an absence of competition for technical reasons and the
goods or services can be supplied only by a particular supplier
and no alternative or substitute exists."

5. OWNERSHIP OF INTELLECTUAL PROPERTY:
The ownership of Intellectual Property will rest with the
Offeror.

6. PERIOD OF THE PROPOSED STANDING OFFER:

One (1) year from date of issuance with option to extend the
Standing Offer by up to two (2) additional one (1) year periods
under the same conditions.

7. ESTIMATED COST OF THE PROPOSED STANDING OFFER:

The estimated yearly cost for this requirement is CAN$ 60,000.00
for an estimated total cost of CAN$ 180,000.00 over three (3)
years, tax included.

Above noted estimated annual expenditure does not represent a
commitment by Canada and is only an estimation of the potential
value of all call-ups which may be placed by the Identified User
against the Standing Offer.

of this notice. The statement of capabilities must clearly
demonstrate how the supplier meets the advertised requirements.

intends to award a good, service or construction contract to a
pre-identified contractor. If no other supplier submits, on or
before the closing date, a Statement of Capabilities that meets
the requirements set out in the ACAN, the contracting authority
may then proceed with the award. However, should a Statement of
Capabilities be found to meet the requirements set out in the
ACAN, then the contracting authority will proceed to a full
tendering process.

statement of capabilities in writing to the contact person
identified in this Notice on or before the closing date of this
Notice. The statement of capabilities must clearly demonstrate

The Crown retains the right to negotiate with suppliers on any
