TITLE: Pollution Containment Booms

1. An Advanced Contract Award Notice (ACAN) is a public notice
indicating to the supplier community that a department or agency
intends to award a contract for goods, services or construction
to a pre-identified supplier, thereby allowing other suppliers
to signal their interest in bidding, by submitting a statement
of capabilities. If no supplier submits a statement of
capabilities that meets the requirements set out in the ACAN, on
or before the closing date stated in the ACAN, the contracting
officer may then proceed with the award to the pre-identified
supplier.

2. Definition of requirement

The technical specifications for the Pollution Containment Booms
are as follows:

LAB 24" oil Containment Boom (or equivalent)

· Eight - 100' section lengths
· Inflatable
· 24" overall height
· 8" freeboard/16" skirt draft
· 28 oz Urethane Fabric
· Single point air inflation with internal foam layer
· 5/16" Galvanized Chain Ballast
· ASTM Universal Slide End Connectors
· Weight 2.25lbs / foot

To include:
· One (1) jumper hose or two (2) end caps section length
· Four (4) Towing Bridges with Tow Ropes
· One (1) Backpack Gas powered Air Blower with hose and nozzle
· One (1) Spare pars and repair kit
· One (1) reusable aluminum Export Air Cargo Crate with top
(partial), one side and one end removable for packing and
deployment
· Operations and Maintenance Manual

3. Criteria for assessment of the Statement of Capabilities

Any interested supplier must demonstrate by way of a statement
of capabilities that its services meets the requirements that
are detailed herein.

4. Justification for the Pre-Identified Supplier

The following points highlight the reasoning for the LAB 24" oil
Containment Boom:

DND presently has one Arctic Pollution Containment System. FSE
would like a second to enhance our capabilities. This was the
long term strategy for Oil Spill Response only constrained by
annual budgetary requirements. In the event of a spill the
second system can be deployed and connected to the compatible
system increasing the boom deployment to 1600 feet. In the event
the spill was remote area and the first system becomes U/S you
would be sending the sig1ft team the same equipment with no
delays for training or different transport requirements.
Training has been provided to the fleet on the existing systems
allowing a quick
and efficient response to any type of spill.

The Lamor Lab 24 is designed for helicopter, air, land and ship
transport.
Purchasing a second system that is not compatible to the Lamor
Lab 24 could cause delays,
spreading of the pollutant delaying clean up and damaging the
Departments reputation.

5. Government Contracts Regulations Exception(s)

The following exception to the Government Contracts Regulations
is invoked for this procurement under subsection 6(d) - "only
one person is capable of performing the work".

6. The period of the proposed contract

The proposed contract is from the date of contract award, to
March 15, 2013.

7. A cost estimate of the proposed contract

The estimated value of the contract, including options(if
applicable), is $60,250.20
(GST/HST extra).

to provide the goods, services or construction services
described in the ACAN, may submit a statement of capabilities in
writing to the contact person identified in this notice on or
before the closing date of this notice. The statement of
capabilities must clearly demonstrate how the supplier meets the
advertised requirements.

10. The closing date for a submission of a statement of
capabilities

The closing date and time for accepting statements of
capabilities is January 22, 2013 at 2:00 P.M. ADT.

An Advance Contract Award Notice (ACAN) allows departments and

calendar days, indicating to the supplier community that it
intends to award a good, service or construction contract to a
pre-identified contractor. If no other supplier submits, on or
before the closing date, a Statement of Capabilities that meets
the requirements set out in the ACAN, the contracting authority
may then proceed with the award. However, should a Statement of
Capabilities be found to meet the requirements set out in the
ACAN, then the contracting authority will proceed to a full
tendering process.

Suppliers who consider themselves fully qualified and available
to provide the services/goods described herein, may submit a
statement of capabilities in writing to the contact person
identified in this Notice on or before the closing date of this
Notice. The statement of capabilities must clearly demonstrate
how the supplier meets the advertised requirements.

The PWGSC file number, the contracting officer's name and the
closing date of the ACAN must appear on the outside of the
envelope in block letters or, in the case of a facsimile
transmission, on the covering page.

The Crown retains the right to negotiate with suppliers on any
procurement.

Documents may be submitted in either official language of Canada.
