Advance Contract Award Notice (ACAN)
An ACAN is a public notice indicating to the supplier community
that a department or agency intends to award a contract for
goods, services or construction to a pre-identified supplier,
thereby allowing other suppliers to signal their interest in
bidding, by submitting a statement of capabilities. If no
supplier submits a statement of capabilities that meets the
requirements set out in the ACAN, on or before the closing date
stated in the ACAN, the contracting officer may then proceed
with the award to the pre-identified supplier.
Definition of the requirement
The Department of Correctional Services of Canada, Corcan at La
Macaza Institute, has a requirement for the supply of various
quantites of tagboard cardboards of the name brand Springhill
, in accordance with the following specifications. The product
must be 175 lbs , 13 cal and 200 lbs and 15 cal thick , as
this is required to manufacture files for their clients such as
the Departments of National Defense and Correctional
Services.These types of cardboards have been used since many
years by these clients and are required to maintain conformancy
with existing orders. Same quantities and products will be
purchased for two periods of one year each. One firm year and
one optional year
Criteria for assessment of the Statement of Capabilities
(Minimum Essential
Requirements)
The offers must be in technical conformance to the items called
for in this requirement in order to be considered. Failure to
meet with this requirement will render the offer non responsive
and the offer will be rejected.
Any interested supplier must demonstrate by way of a statement
of capabilities that its product meets the following
requirements:
Five items will be purchased on an as-and-when required basis
using a Regional Individual Standing offer.
1. Tag cardboard (Springhill), white for archives, acid-free,
no post-consumer fiber, 150 lbs, thickness approximately
0.118 , in rolls. 58 inches in diameter, 14.75 inches wide
and 3 inch core.
Quantity: 30, 000 lbs per year
2. Tag cardboard (Springhill) , white or colour, 11.50 Cal,
size 24 inches by 36 inches.
Quantity: 25,000 sheets per year
3. Tag cardboard (Springhill) , white or colour, 13 Cal, size
24 inches by 36 inches.
Quantity: 30,000 sheets per year
4. Tag cardboard (Springhill), white or colour, 15 Cal, size
24 inches by 36 inches.
Quantity: 15,000 sheets per year
5. Recycled paper # 60 (Encore) Sand los 68M, size 18 inches
by 30 inches.
Quantity: 160,000 sheets per year.
A variation in the quantities of no more than 10% for all the
items will be accepted on each order.
Any other product from the supplier representing 15% of the
total value of the Standing offer may be purchased depending on
the discount offered.
Applicability of the trade agreement(s) to the procurement
This procurement is subject to the following trade agreements.
Justification for the Pre-Identified Supplier
Spicers Canada has been pre-identified as the only known
supplier capable of providing the products called for in this
request and meeting the government's requirements. They are the
exclusive distributor for International Paper's Springhill line
in Canada.
Government Contracts Regulations Exception
The following exception to the Government Contracts Regulations
is invoked for this procurement under subsection 6(d) - "only
one person is capable of performing the work".

The following exclusions and/or limited tendering reasons are
invoked under the section of the trade agreement specified:
Article 506, Procedures for procurement , article 12(a).
Annexe 1001.1a-1 and article no. 1018 - Exception 2 (d).
Procurement (WTO-AGP) - Chapiter XV - Limited Tendering .

Note: In general, the Supply manual refers only to NAFTA and
the WTO-AGP, as the procedural requirements of the other
international trade agreements will be fulfilled following
compliance to the procedural requirements of NAFTA and the
WTO-AGP. See 1.26.16 Bilateral International Trade Agreements.
Ownership of Intellectual Property
No intellectual property will be created during the course of
this Standing offer.
Period of the proposed Standing Offer.
The proposed Standing offer is for a period of 2 years, from
the date of issue until one year and will include an option to
extend it's period for one year.

Suppliers' right to submit a statement of capabilities
Suppliers who consider themselves fully qualified and available
to provide the goods described in the ACAN may submit a
statement of capabilities in writing to the contact person
identified in this notice on or before the closing date of this
notice. The statement of capabilities must clearly demonstrate
how the supplier meets the advertised requirements.
Closing date for a submission of a statement of capabilities
The closing date and time for accepting statements of
capabilities is:
November 12 , 2015 at 14h00 EST.

You are hereby notified that the government intends to negotiate
with one firm only as identified above. Should you have any
questions concerning this requirement, contact the contracting
officer identified above.
An Advance Contract Award Notice (ACAN) allows departments and
agencies to post a notice, for no less than fifteen (15)
calendar days, indicating to the supplier community that it
intends to award a good, service or construction contract to a
pre-identified contractor. If no other supplier submits, on or
before the closing date, a Statement of Capabilities that meets
the requirements set out in the ACAN, the contracting authority
may then proceed with the award. However, should a Statement of
Capabilities be found to meet the requirements set out in the
ACAN, then the contracting authority will proceed to a full
tendering process.
Suppliers who consider themselves fully qualified and available
to provide the services/goods described herein, may submit a
statement of capabilities in writing to the contact person
identified in this Notice on or before the closing date of this
Notice. The statement of capabilities must clearly demonstrate
how the supplier meets the advertised requirements.
The PWGSC file number, the contracting officer's name and the
closing date of the ACAN must appear on the outside of the
envelope in block letters or, in the case of a facsimile
transmission, on the covering page.
The Crown retains the right to negotiate with suppliers on any
procurement.
