The Department of Fisheries and Oceans located in Moncton, NB
has a requirement for the supply of one (1) NordSea 400 x 40 cm
Midwater Trawl.
Mandatory Requirements:
Item 1. NordSea 400 x 40 cm Midwater Trawl complete with
Codend, head rope LOA: 4500, side rope LOA: 3790, small mesh
liner with Codend rings.
Item 2. Spare lower wings and bellies down to the last 10 cm
section with 40 lbs of assorted nylon twine
Item 3. Trawl doors, approximately 2.28 x 1.12 m
Item 4. Cable and harness apparel including hardware and wires
to hook up doors to trawl.
The reason for single tendering is: Government Contract
Regulations, Section 6 (d) is being invoked in this procurement
is the only one person capable of performing the contract.
Justification for the Pre-Identified Supplier:
Crimond Enterprises Limited (formely Nordsea Limited)
manufactured the Nordsea 400x40cm midwater trawl in 1998 for the
annual 4T southern Gulf herring survey. At the time, it was a
joint purchase with the Maurice Lamontagne Institute in Quebec
as we were using the same vessel. Starting in 2013, we changed
vessels for the Gulf based M. Perley. It resulted in conflicts
in the trawl sharing with MLI due to overlap of their use and
ours and the loss of our survey time of one week in 2013. The
Gulf Region Science Branch thus requests this specific midwater
trawl to be used on the Gulf based vessel to fulfill our primary
mandate of assessing the herring stocks in the southern Gulf.
The 400x40cm midwater trawl must be built with the same
specifications and materials as the original trawl used since
1998. This is very important as this trawl is considered as the
standard scientific sampling gear for our herring research and
assessment program. It is crucial to keep the same gear design
(i.e.: dimensions, material, rigging, geometry) to be able to do
inter-annual comparisons and assure continuity and accuracy in
the time series of data which is used as in index of abundance
for 4T herring stock assessments.
Acquiring a trawl from another manufacturer would require
additional inspections during and after the construction of the
trawl and could result in delays, and increase the risk of
acquiring a trawl of slightly different dimensions than the one
that has been used since 1998, and thus could entail extensive
sea trials and gear comparisons to verify and compare the
catchability of the two trawls to assure continuity and accuracy
in the data series. Any delays in the delivery of the trawl,
additional verifications during the construction and additional
tests for comparability with our standard trawl would result in
an substantial increase in cost for DFO and the risk of
impacting the field work (sampling) significantly.
This requirement is subject to the NAFTA/AIT/Columbia/Peru trade
agreements. Limited Tendering Provisions is in accordance with
the Trade Agreements, Articles 506.12 (b) of AIT, Articles
1016.2 (d) of NAFTA, and Columbia/Peru Trade Agreements contain
similar limited tendering provisions to those in the NAFTA.
The total estimated value of the contract is $32,365.00

with one firm only as identified above. Should you have any
questions concerning this requirement, contact the contracting

An Advance Contract Award Notice (ACAN) allows departments and
agencies to post a notice, for no less than fifteen (15)
calendar days, indicating to the supplier community that it
intends to award a good, service or construction contract to a
pre-identified contractor. If no other supplier submits, on or
before the closing date, a Statement of Capabilities that meets
the requirements set out in the ACAN, the contracting authority
may then proceed with the award. However, should a Statement of
Capabilities be found to meet the requirements set out in the
ACAN, then the contracting authority will proceed to a full
tendering process.
Suppliers who consider themselves fully qualified and available
to provide the services/goods described herein, may submit a
statement of capabilities in writing to the contact person
identified in this Notice on or before the closing date of this
Notice. The statement of capabilities must clearly demonstrate
how the supplier meets the advertised requirements.
The PWGSC file number, the contracting officer's name and the
closing date of the ACAN must appear on the outside of the
envelope in block letters or, in the case of a facsimile
transmission, on the covering page.
The Crown retains the right to negotiate with suppliers on any
procurement.
