The Department of National Defence (DND), 17 Wing - WTISS,
Canadian Forces Base Winnipeg, Winnipeg, Manitoba, requires
ClearCube equipment to replace faulty equipment installed in the
1 Cdn Air Div HQ Blade system. Equipment and services required
must be in accordance with the mandatory requirements and
specifications in Annex A, Requirement.

Mandatory delivery date required on or before May 31, 2012.

Delivery is FOB Destination.

Trade Agreements

The following trade agreements are applicable to this
procurement: The Agreement on Internal Trade
(AIT), and the North American Free Trade Agreement (NAFTA).

Government on Internal Trade (AIT), Article 506-12 (a) to ensure
compatibility with existing products, to recognize exclusive
rights, such as exclusive licences, copyright and patent rights,
or to maintain specialized products that must be maintained by
the manufacturer or its representative;

North American Free Trade Agreement (NAFTA), 1016.2. an entity
may use limited tendering procedures in the following
circumstances and subject to the following conditions, as
applicable : (d) for additional deliveries by the original
suppliers that are inteded either as replacement parts or
continuing services for existing suppliers, services or
installations, or as the extension of exisiting suppliers,
services or installatins, where a change of supplier would
complet the entity to procure equipment or services not meeting
reqirements of interchangeability with already existing
equipment or services, icnlduign software to the extent that the
intital procurement of the software was covered by this Chapter;

The Crown retains the right to negotiate with suppliers on any
procurement.
