Advance Contract Award Notice (ACAN)
Requirement
The Department of National Defence (DND) Fleet Maintenance Facility CAPE BRETON (FMFCB) has a requirement for (6) six drums of Reliance AeroTron AT-55 vapour degreaser (330 gallons) with the option to purchase (6) six additional drums(330 gallons) within (1)one year of contract award.
This Advance Contract Award Notice (ACAN)
The purpose of this ACAN is to signal PWGSC’s intention to award a contract with an estimated value of US $33,240.00 for (6) six drums (330 gallons), to JKM Sales Inc. which is the North American distributer for Reliance Specialty Product Inc., Elk Grove Village, IL 600007-5105.
What is an Advance Contract Award Notice (ACAN)?
An ACAN is a public notice indicating to the supplier community that a department or agency intends to award a contract for goods, services or construction to a pre-identified supplier, thereby allowing other suppliers to signal their interest in bidding, by submitting a statement of capabilities. If no supplier submits a statement of capabilities that meets the requirements set out in the ACAN, on or before the closing date stated in the ACAN, the contracting officer may then proceed with the award to the pre-identified supplier.
Justification for the Pre-Identified Supplier
Sole source justification is supported by the following:
The Department of National Defence (DND) Fleet Maintenance Facility CAPE BRETON (FMFCB) has a large Vapour Degreaser tank which was purpose built for our Chemical Plating facility. The previous products used in this tank were DuPont Vertrel SDG, and Abzol, but due to respiratory health concerns and product durability an alternative Vapour Degreasing product is now being sought.
Sole sourcing a contract is permitted in very few exceptional circumstances. This requirement falls into one of these exceptional circumstances since NATC is the only firm capable of performing the contracting (per Government Contracts Regulations section 10.2.10, sub section (d)).
You are hereby notified that DND intends to solicit a bid and negotiate with one supplier only, as identified above. Although DND considers the above situation to be unique, any supplier that has the identified qualifications is advised to contact the DND Contracting Authority (contact information below).
Other Qualified Suppliers May Submit a Statement of Capabilities
Suppliers who consider themselves fully qualified and available to provide the services described herein may submit a statement of capabilities by e-mail to the contact person identified in this ACAN on, or before, the closing date of this ACAN. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements.
Criteria for Assessment of the Statement of Capabilities -
Minimum Mandatory Requirements
Minimum Mandatory Requirement Requirement Definition Meets/Does Not Meet
1.1 Product must work in a Baron Blakeslee Vapour Degreaser tank without modifications to the tank. Industry term - ?drop in’ chemicals for this specific tank Note the tank is custom sized for DND and contains 120 gallons of cleaning fluid (not immersion).
1.2 Product must be capable of cleaning ?aged’ grease/dirt/grime from a variety of ship’s components. Examples of such components are engine, weapon, electronic components and other components/items built out of a shop. Note: aged grease/dirt/grime may be on items that have been in service for over 10 years in locations such as engine rooms onboard ships.
1.3 Product must meet a minimum safety requirement (OSHA and/or CCOHS) of 200 PPM’s Threshold Limit Value (TLV) while in use. Safety concern for worker exposure to chemicals/vapours, both for workers at the tank, and other workers within the vicinity of the tank. Tank is located within a large plating facility.
1.4 Product must be compatible with a wide variety of metals without adverse effects to the substrates. Metals processed include aluminum, steel, iron, magnesium, stainless steel, copper, brass.
1.5 Product must be able to retain its cleaning capability over a minimum of 5 years with no cleaning degradation. Disposal costs for chemicals are very expensive, as well as down time for pumping out and cleaning tanks. It is understood that there will be loss of degreaser from the tank requiring periodic top-ups.
1.6 Product must be ?green’, potentially a product that is recyclable. The product will only require simple filtering or reconditioning to remove contaminants to remain in use or to be recycled. Reclamation using distillation is acceptable.
1.7 Product must have a cleaning effectiveness of 99% of surface contaminants for aged contaminants. Most degreasing functions are the starting point of plating functions, which are intolerant of contaminants.
Any interested supplier must demonstrate by way of a statement of capabilities that it meets the following requirements:
Closing Date and Process for Submitting Statement of Capabilities
The closing date for accepting statements of capabilities is August 3, 2017 @ 2pm (PST).
Written responses quoting the solicitation number W3555-188013/A are to be directed to the DND Contracting Officer by email:

Delivery Date: Above-mentioned
You are hereby notified that the government intends to negotiate with one firm only as identified above. Should you have any questions concerning this requirement, contact the contracting officer identified above.
An Advance Contract Award Notice (ACAN) allows departments and agencies to post a notice, for no less than fifteen (15) calendar days, indicating to the supplier community that it intends to award a good, service or construction contract to a pre-identified contractor. If no other supplier submits, on or before the closing date, a Statement of Capabilities that meets the requirements set out in the ACAN, the contracting authority may then proceed with the award. However, should a Statement of Capabilities be found to meet the requirements set out in the ACAN, then the contracting authority will proceed to a full tendering process.
Suppliers who consider themselves fully qualified and available to provide the services/goods described herein, may submit a statement of capabilities in writing to the contact person identified in this Notice on or before the closing date of this Notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements.
The PWGSC file number, the contracting officer's name and the closing date of the ACAN must appear on the outside of the envelope in block letters or, in the case of a facsimile transmission, on the covering page.
The Crown retains the right to negotiate with suppliers on any procurement.
