1. Definition
An Advance Contract Award Notice (ACAN) allows departments and agencies to post a notice, for no less than fifteen (15) calendar days, indicating to the supplier community that it intends to award a good, service or construction contract to a pre-identified contractor. If no other supplier submits, on or before the closing date, a Statement of Capabilities that meets the requirements set out in the ACAN, the competitive requirements of the government's contracting policy have been met. Following notification to suppliers not successful in demonstrating that their Statement of Capabilities meets the requirements set out in the ACAN, the contract may then be awarded using the Treasury Board's electronic bidding authorities.
If other potential suppliers submit Statement of Capabilities during the fifteen calendar day posting period, and meet the requirements set out in the ACAN, the department or agency must proceed to a full tendering process on either the government's electronic tendering service or through traditional means, in order to award the contract.
2. Definition of Requirements
Natural Resources Canada has a requirement for the provision of a one (1) year contract with (4) one (1) year option periods for technical support, system maintenance, site hosting on DENSAN servers and on going enhancements to NewsLink.
The objective of the service contract is as follows:
- unlimited on site & telephone support
- Web page redesign, custom features and server migration
- free upgrades to all new versions of the Software Programs
- free problem resolution modifications (bug fixes) to the
- free participation in all NewsLink User Group activities for the designated NRCan contact(s);
- external Site Hosting: maintenance and support
- provision of 2 backup servers, one in-house and one on a managed backup server located off-site for added redundancy

There is no trade agreement impacted by this contract
4. Title to Intellectual property
The vendor has exclusive ownership of the source code and corresponding intellectual property (IP) for the Newslink media monitoring software which forms the basis for the NRCan Daily Compass system. No other distributor is authorized to modify or enhance the Densan software.
5. Contract Period
The period of the contract will be from April 1, 2015 to March 31, 2016, with provisions for four (4) additional twelve months option periods to be exercised at the discretion of the project Authority.
6. Estimated Cost
The estimated maximum value of the contract is $62,500 CAD, HST excluded (which includes $12,500.00 for the first year and $50,000.00 for the four option years).
7. Exception to the Government Contracts Regulations and applicable trade agreements
(d) Only one person or firm is capable of performing this contract.
Natural Resources Canada (NRCan) owns a perpetual license for the Densan Newslink product that powers its Newslink site.
The vendor has exclusive ownership of the source code and corresponding intellectual property (IP) for the Newslink media monitoring software which forms the basis for the NRCan Daily Compass system.
No other distributor is authorized to modify or enhance the Densan software. Therefore, this service provider is the only company that is able to provide technical support, system maintenance, site hosting, and on-going enhancements to NewsLink. As well as provide NRCan with new feature that is developed, at no extra cost.

9. Inquiries on Submission of Statement of Capabilities
Any interested supplier must demonstrate by way of a Statement of Capabilities that it meets the following minimum requirements:
a) Unlimited on-site and telephone support for all NewsLink Software Programs to the designated contact(s);
b) Web page redesign, custom features and server migration (up to 15 days)
c) Free upgrades to all new versions of the NewsLink Software Programs that have been purchased;
d) Free problem resolution modifications (bug fixes) to the NewsLink software modules;
e) Free participation in all NewsLink User Group activities for the designated contact(s); and
f) External Site Hosting - maintenance and support.
The contractor will provide to Natural Resources Canada, for the duration of this Agreement, between 7:30 am and 5:30 pm., Monday to Friday, excluding holidays, all services outlined above.
"Suppliers who consider themselves fully qualified and available to provide the services/goods described herein, may submit a Statement of Capabilities in writing, preferably by e-mail, to the contact person identified in this Notice on or before the closing date and time of this Notice. The Statement of Capabilities must clearly demonstrate how the supplier meets the advertised requirements."
10. Closing Date
The closing date for a submission of a Statement of Capabilities is March 17, 2015 at 14:00 Eastern Standard Time.
