An Advance Contract Award Notice (ACAN) allows departments and agencies to post a notice, for no less than fifteen calendar days, indicating to the supplier community that it intends to award a good, service or construction contract to a pre identified contractor. If no other supplier submits, on or before the closing date, a statement of capabilities that meets the requirements set out in the ACAN, the competitive requirements of the government’s contracting policy have been met. Following notification to suppliers not successful in demonstrating that their statement of capabilities meets the requirements set out in the ACAN, the contract may then be awarded using the Treasury Board’s electronic bidding authorities. If other potential suppliers submit statements of capabilities during the fifteen calendar day posting period, and meet the requirements set out in the ACAN, the department or agency must proceed to a full tendering process on either the government’s electronic tendering service or through traditional means, in order to award the contract.
Provisions in accordance with the Government Contracts Regulations - only one person or firm are capable of performing the contract.
The National Research Council wishes to award a contract to Sitek Process Solutions for an identical 150PV UV Stabiliser tool. The Stabiliser tool was acquired by Spectris PLC and then subsequently acquired by Heraeus Noblelight. The Fusion tool is an obsolete tool and is unsupported by Heraeus Noblelight. NRC has found a company and to the best of our knowledge the only company that’s able to refurbish the existing Fusion UV curing tools to the Original Specifications from the OEM. For reasons of interchangeability of parts components, reverse compatibility of data and established research protocols and methodologies we wish to issue a direct award to Sitek Process Solutions for refurbishment services.

Contract duration is to commence upon contract signature and terminate 6 weeks after contracts awarded Contract may be subject to negotiation with the supplier.
IP: There are no IP considerations for this contract.
Suppliers who consider themselves fully qualified and available to provide the services/goods described herein (including the interdependency criteria from a scheduling perspective with other work being done internally that results in, as well as impacts, the timeline alluded to above), as well as with the necessary expertise and appropriate contacts with relevant and major global semiconductor memory device manufacturers for the associated critical market analyses (and understanding of paths to markets), may submit a statement of capabilities in writing to the contact person identified in this Notice on or before the closing date of this Notice. The statement of capabilities must clearly demonstrate how the supplier meets all of the advertised requirements.
