1. INTRODUCTION
It is the intent of Public Works & Government Services Canada
(PWGSC), to negotiate on a sole source basis with Engravers
Express Inc. to provide a Epilog Helix 24 Laser Engraver, on
behalf of the Department of National Defence (DND), located in
Winnipeg, Manitoba.
2. BACKGROUND
In its support of the 1 Canadian Air Division (1 CAD)
headquarters located in Winnipeg, Manitoba, the 1 CAD Graphics
Department and Print Shop designs and produces a variety of
graphical work. With the use of a laser engraver, the Graphics
Department has been able to produce a variety of signage, awards
and presentation gifts for its clients in the headquarters. The
existing laser engraver is at the end of its life cycle and in
poor working condition.
3. REQUIREMENT
DND requires the purchase of a new laser engraver with a 10 Base
T Ethernet network connection. Due to space restrictions and an
external exhaust requirement, the laser engraver is located in a
separate room from the workstations. The Ethernet capability
allows jobs to be sent from any of the workstations and does not
require a dedicated PC attached to the engraver for the sole
purpose of sending files to the engraver. The Ethernet
connection provides the most reliable data transfer over long
distances.
4. MANDATORY SPECIFICATIONS
It is a mandatory requirement that the laser engraver meets the
following criteria:
Must have a 10 Base T Ethernet network connection
Physical dimension must not exceed 38" wide x 30" deep to fit in
available space
Must have a 24" x 18" engraving area
Must have air assist and an air filter system
Must be capable of rotary engraving
Must have auto and manual focus
Must be capable of raster engraving and vector cutting
Must be compatible with 64 bit Windows XP Pro and Windows 7
operating systems
Laser tube must have 75 watts of power to provide medium-high
power for high productivity engraving and cutting operations for
pieces greater than ½" thick
5. SOLE SOURCE JUSTIFICATION
Engraver's Express is the only known supplier of the Epilog
series of laser engravers. Epilog is the only known laser
engraver to offer a 10 Base T Ethernet connection.
6. TRADE AGREEMENTS:
Agreement on Internal Trade (AIT) / North American Free Trade
Agreement (NAFTA) applies to this proposed procurement.
7. SOLE SOURCE JUSTIFICATIONS:
Government Contracts Regulations (GCR) and Limited Tendering
Reasons:
GCR Part 1, Section 6
(d) Only one supplier (person or firm) is capable of performing
the contract.
AIT - Article 506, Section 12 (b)
Where only one supplier is able to meet the requirements of a
procurement, an entity may use procurement procedures that are
different from those described paragraphs 1 through 10, in the
following circumstances:
(b) where there is an absence of competition for technical
reasons and the goods or services can be supplied only by a
particular supplier and no alternative or substitute exists.
NAFTA - Article 1016, Section 2 (b)
An entity may use limited tendering procedures in the following
circumstances and subject to the following conditions, as
applicable:
b) where, for works of art, or for reasons connected with the
protection of patents, copyrights or other exclusive rights, or
proprietary information or where there is an absence of
competition for technical reasons, the goods or services can be
supplied only by a particular supplier and no reasonable
alternative or substitute exists;
8. DELIVERY Date:
Mandatory Delivery Date is March 31, 2013.
9. ESTIMATE OF THE COST OF THE PROPOSED CONTRACT: $48,000.00

Notice. The statement of capabilities must clearly demonstrate
how the supplier meets the advertised requirements.

You are hereby notified that the government intends to negotiate
with one firm only as identified above. Should you have any
questions concerning this requirement, contact the contracting
officer identified above.
An Advance Contract Award Notice (ACAN) allows departments and
agencies to post a notice, for no less than fifteen (15)
calendar days, indicating to the supplier community that it
intends to award a good, service or construction contract to a
pre-identified contractor. If no other supplier submits, on or
before the closing date, a Statement of Capabilities that meets
the requirements set out in the ACAN, the contracting authority
may then proceed with the award. However, should a Statement of
Capabilities be found to meet the requirements set out in the
ACAN, then the contracting authority will proceed to a full
tendering process.

The Crown retains the right to negotiate with suppliers on any
procurement.
