Amendment # 1 : A mistake was done while entering the closing date and time. It should be June 25, 2015 at 10h00am.

1. PURPOSE OF AN ACAN
An Advance Contract Award Notice (ACAN) allows departments to post a notice, for no less than fifteen calendar days, indicating to the supplier community that it intends to award a service contract (or for goods or construction contract) to a pre-identified contractor. If no other supplier submits, on or before the closing date, a statement of capabilities that meets the requirements set out in the ACAN, the competitive requirements of the government’s contracting policy have been met. If other potential suppliers submit statements of capabilities during the fifteen calendar days posting period, and meet the requirements set out in the ACAN, the department must then proceed to a full tendering process either via the government’s electronic tendering service (BuyandSell) or through traditional means, in order to award the contract.

2. STATEMENT OF CAPABILITIES:
Suppliers who consider themselves fully qualified and available to provide the services described herein may submit a statement of capabilities by email at N••••••••@••••••••.••.ca referencing this Notice # 100 004 267 to the responsible contracting officer identified in this notice on or before the closing date and time of this notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirement.

3. DEPARTMENT’S REQUIREMENT:
The Department of Employment and Social Development Canada (ESDC) has a requirement for the provision of up to 25,000 subscriptions to a fully functional “Saba Cloud” application in a fully managed operating environment. These subscriptions will be used to support their learning management requirements. The functionality afforded by the Saba Cloud application will be made accessible to all ESDC staff, and be fully managed and supported by the vendor in a “cloud environment”.

Background
The Department of Employment and Social Development Canada (ESDC) currently has a Learning Management System (LMS) that is at the end of its life cycle and requires significant updating. This LMS is also operated on infrastructure that is being decommissioned in June 2015. ESDC must have access to an LMS to effectively and efficiently manage training delivery.

The Saba LMS is the predominant LMS in use within the Government of Canada. The Treasury Board of Canada encourages departments to standardize its use. Initiatives are under way for deciding on how the Government of Canada will be moving forward vis-a-vis an Enterprise Level LMS. Thus the ESDC requirement is for a solution that will act as a bridge between now and when a decision is made on the long term solution.

The requirement is to provide:
1. delivery of up to 25,000 subscriptions for Saba’s Commercial Off-The-Shelf (COTS) known as “Saba Cloud”. This expenditure is to include the full cost of all of the subscription licenses to be operational, fully functional and secure within the vendor-provided Data Centre. This also includes ensuring that the subscriptions are maintained at the latest version of the software.

2. configuration of ESDC’s Saba Cloud and turn-over of the subscriptions to C••••••@••••.The preparation work also includes technical and business consulting resources from Saba to perform the actual configuration, as well as ongoing access to the latest documentation and training materials.

3. provision of consultants, experienced in the delivery of Saba Cloud, that will work with the College@ESDC on project management, business analysts, change management and data management staff to work with to migrate from the College’s “Legacy Systems” to the Saba Cloud environment.

Core to this ESDC requirement is experience in the delivery and maintenance of a Saba Cloud environment.

4. MINIMUM ESSENTIAL REQUIREMENTS:
Any interested supplier must demonstrate by way of a statement of capabilities that it meets the following requirements:

  • Ability to supply Canada with subscriptions to the Saba Cloud application;
  • Experience in working with clients in the configuration of the Saba Cloud application to meet client needs;
  • Experience in the migration from a client’s Legacy Systems to the Saba Cloud application;
  • Experience in the management of both:

o projects to commission and operate Saba Cloud instances, and
o the ongoing operations associated with the Saba Cloud.

5. CONTRACT PERIOD:
The period of the Contract is from June 30, 2015 to June 29, 2017 inclusively.

5.1 Option to Extend the Contract
The Contractor grants to Canada the irrevocable option to extend the term of the Contract by up to one additional year (12 months) under the same conditions. The Contractor agrees that, during the extended period of the Contract, it will be paid in accordance with the applicable provisions as set out in the Basis of Payment.

Canada may exercise this option at any time by sending a written notice to the Contractor at least 15 calendar days before the expiry date of the Contract. The option may only be exercised by the Contracting Authority, and will be evidenced for administrative purposes only, through a contract amendment.

6. CONTRACT VALUE:
The value for the initial period is $1,353,540 CAN plus applicable taxes. The irrevocable option for an additional one year is valued at $385,590.00 CAN plus applicable taxes.

7. SOLE SOURCE JUSTIFICATION:
Government Contracts Regulations, Section 6(d) only one person or firm is capable of performing the contract is being invoked for this contract requirement as per TB Revised Policy).

Saba Cloud is Saba’s newest product that delivers the required functionality. Saba has taken the strategic decision to be the only supplier of Saba Cloud subscriptions and their configuration and operation. It is important to note that Saba is the operator of the infrastructure that the Saba Cloud operates on. There are no other companies that operate Saba Cloud instances and sell subscriptions for their use. To date, Saba has been the only company installing or configuring Saba Cloud instances.
