1. Advance Contract Award Notice (ACAN)
An ACAN is a public notice indicating to the supplier community
that a department or agency intends to award a contract for
goods, services or construction to a pre-identified supplier,
thereby allowing other suppliers to signal their interest in
bidding, by submitting a statement of capabilities. If no
supplier submits a statement of capabilities that meets the
requirements set out in the ACAN, on or before the closing date
stated in the ACAN, the contracting officer may then proceed
with the award to the pre-identified supplier.
2. Definition of requirement
The Department of National Defense - CFB Borden has a
requirement for the provision of services as specified under
"Background" below. The purpose of this Advance Contract Award
Notice (ACAN) is to signal the government's intention to award a
contract for these services to ATCO Structures and Logistics,
Cookstown, Ontario. Before awarding a contract, however, the
government would like to provide other suppliers with the
opportunity to demonstrate that they are capable of satisfying
the requirements set out in this Notice, by submitting a
statement of capabilities during the 15 calendar day posting
period. If no supplier submits a statement of capabilities that
meets the requirements set out in the ACAN, on or before the
closing date stated in the ACAN, the contracting officer may
then proceed with the award to the pre-identified supplier.
Background
Public Works and Government Services Canada on behalf of The
Department of National Defense (DND) - CFB Borden in the Ontario
Region has a requirement for the rental supply of ten (10) 12 x
60 ft office trailers. The trailers are required for a rental
period from June 1, 2014 to August 31, 2014. These trailers will
be installed at CFB Borden - Blackdown Park for cadet summer
camp.
The contractor will provide and complete all aspects of delivery
by June 1, 2014, including delivery, transport, set-up,
levelling, blocking, installation and completion of all trailer
modifications.
3. Criteria for assessment of the Statement of Capabilities
Minimum Essential Requirements
Any interested supplier must demonstrate by way of statement of
capabilities that it meets the following requirements:
(a) The bidder must deliver for rent, the supply of ten (10)
12x60 ft office trailers by June 1, 2014.
(b) Complete delivery of trailers by June 1, 2014 must include
set-up, leveling, blocking and installation at CFB Borden -
Blackdown Park with all modifications completed.
4. Applicability of the trade agreement(s) to the procurement
This procurement is subject to the following trade agreements:
Agreement on Internal Trade (AIT)
North American Free Trade Agreement (NAFTA)
5. Justification for the Pre-Identified Supplier
ATCO Structures and Logistics is the only known commercial
organization available solution capable of providing 10 trailers
for rent, which are 12 x 60' ft in size, and delivered by June
1, 2014. No other organization is known to possess the trailer
units available with the ability to complete all of the
associated deliverables by the delivery date specified above.
6. Government Contracts Regulations Exception:
The following exception to the Government Contracts Regulations
is invoked for this procurement under subsection 6(d) - only one
person is capable of performing the work.
7. Exclusions and/or Limited Tendering Reasons
The following exclusion(s) and/or limited tendering reasons are
invoked under the section of the trade agreement(s) specified:
Agreement on Internal Trade (AIT) Article 506.12b) Where only
one supplier is able to meet the requirements of a procurement,
an entity may use procurement procedures that are different from
those described in paragraphs 1 through 10 in the following
circumstances:
(b) where there is an absence of competition for technical
reasons and the goods or services can be supplied only by a
particular supplier and no alternative or substitute exists;
North American Free Trade Agreement (NAFTA) Article 1016:
Limited Tendering Procedures. An entity may use limited
tendering procedures in the following circumstances and subject
to the following conditions, as applicable:
(b) where, for works of art, or for reasons connected with the
protection of patents, copyrights or other exclusive rights, or
proprietary information or where there is an absence of
competition for technical reasons, the goods or services can be
supplied only by a particular supplier and no reasonable
alternative or substitute exists;
8. The period of the proposed contract or the delivery date(s)
The products must be delivered on or before June 1, 2014.
The period of the contract is from June 1, 2014 to August 31,
2014.
9. A cost estimate of the proposed contract.
The estimated value of the contract is $72,400 (Applicable Taxes
extra).

described in the ACAN, may submit a statement of capabilities in
writing to the contact person identified in this notice on or
before the closing date of this notice. The statement of
capabilities must clearly demonstrate how the supplier meets the
advertised requirements.
12. The closing date for a submission of a statement of
capabilities.
The closing date and time for accepting statements of
capabilities is May 27, 2014 at 2:00 p.m. EDT.
