1) ADVANCE CONTRACT AWARD NOTICE (ACAN)
An ACAN is a public notice indicating to the supplier community
that a department or agency intends to award a contract for
goods, services or construction to a pre-identified supplier,
thereby allowing other suppliers to signal their interest in
bidding, by submitting a statement of capabilities. If no
supplier submits a statement of capabilities that meets the
requirements set out in the ACAN, or before the closing date
stated in the ACAN, the contracting officer may then proceed
with the award to the pre-identified supplier.
2) DEFINITION OF THE REQUIREMENT
The Institute of Oceans Sciences (IOS)of the Department of
Fisheries and Oceans (DFO) located in Sidney, British Columbia,
Canada has a requirement for a multisampling system suitable for
the depth or distance stratified sampling of oceanic
zooplankton.
The only system identified as currently meeting DFO's
operational requirements as detailed in this advance contract
award notice is the "Multi Planton Sampler MultiNet® Type Midi"
sampling system manufactured by Hydro-Bios, Germany, equipped
with Conductivity/Temperature sensor Set (CT-Set) and Pitch and
Roll Sensor, and for which Environmental Analytical Systems
holds exclusive distribution rights in the Canadian market
3) CRITERIA FOR ASSESSMENT OF THE STATEMENT OF CAPABILITIES
(MINIMUM ESSENTIAL REQUIREMENTS)
Any interested supplier must demonstrate by way of a statement
of capabilities that its system equipment offering meets the
following minimum mandatory requirements:
The system must be capable of:
a) sampling at least 5 discrete sampling depths (using separate
nets) per tow.
b) a sampling depth range of at least 3000m.
c) capable of vertical or horizontal towing.
d) deploying nets by both surface controlled and internally
preprogrammed.
e) surface control via deck command unit (push button net
deployment) and/or PC computer interface with software.
f) net status, conductivity, depth, water flows (internal to
net and external to frame), and tilt/roll data
transmission from instrument to surface in real time or recorded
internally.
g) nets and cod-ends (buckets) removable and replaceable in
the field (on deck).
h) Internal operation programming via PC computer RS-232
interface.
i) surface control requires real-time bi-directional data
transfer over conducting cable.
j) 0.25 m2 net opening (50cm x 50cm).
k) onboard battery (no power requirement from surface).
l) high-quality stainless steel frame construction for use in
high salinity oceanic conditions.

7) JUSTIFICATION FOR THE PRE-IDENTIFIED SUPPLIER
Environmental Analytical Systems is the only known supplier who
can supply and deliver a system that can meet the minimum
essential requirements detailed under Paragraph 3.
8) GOVERNMENT CONTRACT REGULATIONS EXCEPTION(S):
The following exception(s) to the Government Contracts
Regulations is (are) invoked for this procurement under
subsection 6(d) "only one person is capable of performing the
work".
9) EXCLUSIONS AND/OR LIMITED TENDERING REASONS
The following limited tendering reasons are invoked under the:
there is an absence of competition for technical reasons and the
goods or services can be supplied only by a particular supplier
and no alternative or substitute exists";
1016.2(b) "where for works of art, or for reasons connected with
the protection of patents, copyrights or other exclusive rights,
or proprietary information or where there is an absence of
competition for technical reasons, the goods or services can be
supplied only by a particular supplier and no reasonable
alternative or substitute exists"; and
10) PERIOD OF THE PROPOSED CONTRACT OR DELIVERY DATE
All deliverables must be received at Destination in Sidney
(British Columbia) Canada V8L 4B2 on or
before March 31, 2015 (MANDATORY).
11) COST ESTIMATE OF THE PROPOSED CONTRACT
The estimated value of the contract is CAD $94,270.00,
Delivered Duty Paid (DDP) Sidney BC Canada V8L 4B2, excluding
Applicable Taxes, shipping charges, Canadian customs duties, and
excise taxes included.

to provide the goods, services or construction services
described in the ACAN may submit a statement of capabilities in
writing to the contact person identified in this notice on or
before the closing date of this notice. The statement of
capabilities must clearly demonstrate how the supplier meets the
advertised requirements.
14) CLOSING DATE FOR A SUBMISSION OF STATEMENT OF CAPABILITIES
The closing date and time for accepting statements of
capabilities is as specified above.

calendar days, indicating to the supplier community that it
intends to award a good, service or construction contract to a
pre-identified contractor. If no other supplier submits, on or
before the closing date, a Statement of Capabilities that meets
the requirements set out in the ACAN, the contracting authority
may then proceed with the award. However, should a Statement of
Capabilities be found to meet the requirements set out in the
ACAN, then the contracting authority will proceed to a full
tendering process.
