REPAIR AND OVERHAUL OF OPTICAL FIRE CONTROL DEVICES

1. ADVANCE CONTRACT AWARD NOTICE:
An Advance Contract Award Notice (ACAN) allows departments and
agencies to post a notice, for no less than fifteen (15)
calendar days, indicating to the supplier community that it
intends to award a good, service or construction contract to a
pre-identified contractor. If no other supplier submits, on or
before the closing date, a Statement of Capabilities that meets
the requirements set out in the ACAN, the contracting authority
may then proceed with the award.
2. REQUIREMENTS:
a) The Department of National Defence (DND) has a requirement
for the provision the Repair and Overhaul of Artillary Optical
Fire Control Instruments and Ancillary Equipment as listed below:
The purpose of this Advance Contract Award Notice (ACAN) is to
signal the government's intention to award a contract for the
repair and overhaul activities to Kaycom Inc. Pointe Claire
Quebec. Before awarding a contract, however, the government
would like to provide other suppliers with the opportunity to
demonstrate that they are capable of satisfying the requirements
set out in this Notice, by submitting a statement of
capabilities during the 15 calendar day posting period.
3. MINIMUM REQUIREMENTS
Any interested supplier must demonstrate by way of a statement
of capabilities that it meets the following requirements:
Facilities. The bidder must have an existing or have access to
an existing dedicated precision mechanical and optronic repair
facility, which shall provide the functionality, as a minimum,
per Canadian Forces Technical Order (CFTO) C-04-020-004/AG-000,
Optronics Repair Work Centre Facilities or commercial
equivalent.
Tools and Test Equipment. The contractor, in addition to
common precision mechanical and optical hand tools, shall
have access to the following tools and test equipment, as a
minimum, in support of this requirement:
a. Dioptometer (-1 to +1 diopter range);
b. Collimator, General Purpose (infinity focus);
c. Adapters as required for mounting optical equipment;
d. Cross levelling and elevation fixture (Simulated Gun
Fixture) with Adapters (accuracy to 0.25 mil); and
e. Refinishing tools and dedicated paint bay or booth for items
up to 1.0 m3 in volume.
Technical Support. Upon tasking, the contractor shall provide
Technical Investigation and Engineering Services (TIES) for
the optical and optronics equipment outlined herein. A
technical capability must therefore be available to the
Contractor in the fields of electrical, precision mechanical,
optical and instrument repair for the equipment contained
herein.
Technical Data Packages. The contractor shall have access to
the Technical Data Packages for the instruments and equipment
as described above.
Controlled Goods Registration
CONTROLLED GOODS REGISTRATION PROGRAM
The Controlled Goods Registration Program established under
Bill S-25 to the Defence Production Act applies to this
procurement. For Canadian Companies to be eligible to obtain a
Contract, they must be registered under the Controlled Goods
Registration Program (CGRP). Bids from Canadian Companies must
contain a statement confirming that they are registered under

4. JUSTIFICATION FOR PRE-SELECTED SUPPLIER
The Original Equipment Manufacturer for the majority of the
instruments is Seiler Instrument of St Louis MO. USA. Seiler's
sole representative in Canada is Kaycom Inc. And as such
alsohave access to the Technical Data Package. Kaycom have been
the sole and only successful bidder for the Repair and Overhaul
of these instruments for at least the past 20 years.
5. APPLICABILITY OF TRADE AGREEMENTS OR OTHER OBLIGATIONS:
As the majority of the items falls under stock code 12 the
requirement is excluded the North American Free Trade Agreement
(NAFTA), the World Trade Organization-Agreement on Government
Procurement (WTO-AGP), and the Comprehensive Land Claims
Agreement (CLCAs). The Agreement on Internal Trade (AIT)
applies.
6. OWNERSHIP OF INTELLECTUAL PROPERTY: It is not expected that
intellectual property will be created during the course of the
contract.
7. THE PERIOD OF THE PROPOSED CONTRACT: 3 years plus 4 option
years
8. ESTIMATED COST: $1,900,000
9. SUPPLIERS' RIGHT TO SUBMIT A STATEMENT OF CAPABILITIES:
Suppliers who consider themselves fully qualified and available
to provide the services/goods described herein, may submit a
statement of capabilities in writing to the contact person
identified in this Notice on or before the closing date of this
Notice. The statement of capabilities must clearly demonstrate
how the supplier meets the advertised requirements.

closing date of the ACAN must appear on the outside of the
envelope in block letters or, in the case of a facsimile
transmission, on the covering page.
The Crown retains the right to negotiate with suppliers on any
procurement.
