The Government of Alberta has recently passed amendments to the Builders Lien Act RSA 2000, c.B-7 as amended from time to time. These amendments established a prompt payment and prompt payment adjudication framework for construction contracts in the Province of Alberta. Adjudicators hearing such disputes must do so as part of a “Nominating Authority”. Nominating Authorities are to establish a framework within which disputes be resolved by adjudicators in accordance with the Act and Regulations. The Minister of Service Alberta (the Province) is responsible for the designation of Nominating Authorities, therefore seeks to establish a Standing Offer List for Nominating Authorities. The purpose of this Pre-Qualification Request process is to identify Pre-Qualified Contractors with the ability to provide Nominating Authority Services. Pre-Qualified Contractors will enter into Master Agreements with the Province from the Effective Date of the Master Agreement until May 31, 2025. The Province may extend the Master Agreements for an additional term of up to two (2) years. It is the Province’s intention to have the dispute resolution process available to the public by August 29, 2022. Please see the attached Pre-Qualification Request document for details.
