ADVANCE CONTRACT AWARD NOTICE (ACAN):

Service and Maintenance of Canadian Air Defence Radio System
(CADRS) Installations at Navigation Canada (NavCan) Sites

1. Definition of Requirement

1.1 Scope:

1.1.1 Purpose

This Statement of Requirement (SOR) covers the requirements of
the Department of National Defence (DND) related to the
services and maintenance to be provided for the Canadian Ait
Defence Radio System (CADRS) installations located at
Navigation Canada (NavCan) sites.

1.1.2 Background

DND has a number of Air Defence Radio Systems installed at
various locations throughout Canada. These installations
provide 22 Wing North Bay the ability to control Canadian and
Allied aircraft carrying out missions related to the defence
of Canada and North America. These sites have been established
to provide radio coverage across Canada to protect major
population centers.

1.2 Requirements:

This document will identify the services and maintenance to be
provided with respect to maintaining the CADRS installations
at NavCan sites. This will provide 22 Wing North bay Air
Defence Systems Maintenance (ADMS) with the ability to
maintain a functional Air Defence radio network within Canada.
Operational requirements have dictated the placement of these
radios and any discussions on these requirements must be held
keeping in mind a "need to know" restriction.

1.3 General:

The work detailed in this SOR must be provided on a as needed
and when required basis. as needed and when required basis.
This must involve all eleven (11) sites as detailed below, 24
hours a day, 7 days a week, and 365 days a year for the
duration of the contract. The sites are located in British
Columbia, Northwest Territories, Alberta, Saskatchewan,
Nunavut, Quebec and Labrador. Prior to release of specific
site information, requirements as identified in Article 2
(Criteria for Assessment of the Statement of Capabilities) must
be met.

1.3.1 Work Activities (Authorised through Task Authorisations -
DND 626):
Major activities required under this contract must consist of
the following Work Items, unless otherwise authorised by 22
Wing ADSM. In case of non-Work Item changes ADSM will inform
the DND Procurement Authority (PA) immediately by e-mail.
Under normal operational scenarios 22 Wing ADSM will initiate a
"trouble Ticket" but the maintenance organisation may also
initiate a "Trouble Ticket" by contacting ADSM. Each "Trouble
Ticket" will be authorised by the Duty Technician at 22 Wing
ADSM whether the requirement is initiated by the site or 22
Wing.

1.3.2 No maintenance actions will take place until a "Trouble
Ticket" has been raised. Upon completion of a "Trouble
Ticket" the maintenance organisation will inform 22 Wing ADSM
of the work that was carried out to rectify the ticket by Work
Item.

1.3.3 Due to the nature of this system (CADRS), all work done
under Work Item 1 and 2 are "Unscheduled Repairs" while Work
Item 3 is a "Scheduled Repair". All costs related to work
done under any Work Item, whether considered to be Scheduled
or Unscheduled, must be completed at the contracted rates and
mark-ups found in the resulting Contract.

1.3.4 Work Item 1: System Repairs

The Contractor's technical personnel must carry out system
repairs when problems at a site have been identified and
authorised by 22 Wing ADSM. This must include ordering of
replacement parts from 22 Wing when required and the return of
all parts following confirmation of site serviceability. The
following list identifies the basic work required that
includes, but is not limited to, the following:

A) Conduct verification of the equipment to isolate the
fault(s):
B) Replace faulty equipment after receipt of spares (refer to
Article 1.5)
C) Conduct serviceability tests in conjunction with 22 Wing
ADSM; and
D) Return all equipment ordered from ADSM, at DND's expense to
the location identified by 22 Wing ADSM.

1.3.5 Work Item 2: Antenna Replacement

The Contractor's technical personnel must provide antenna
replacement services upon request from DND or if during fault
verification it is determined that the antenna needs
replacement. DND will provide the replacement antenna and ship
to the site or as directed by the technical personnel. The
removed antenna must be returned to DND as directed by 22 Wing
ADSM. Substitution of an antenna by a new type must not occur
without the direct approval of the Technical Authority (TA).
1.3.6 Work Item 3: Equipment Modifications

The Contractor's technical personnel must perform equipment and
system modifications in accordance with instructions that may
be issued from time to time by the TA. Downtime to carry out
the work must be arranged with 22 Wing ADSM who will open a
"Trouble Ticket" for the work at each site. Upon completion
of the modification the technical personnel will advise 22 Wing
ADSM and again upon completion of serviceability testing.

1.3.6.1 Prior to the issue of any modification, it will be
discussed with NavCan. This will allow time to ensure that
the modification will not adversely affect NavCan equipment
or systems after installation.

1.3.7 Work Item 4: Minor Repairs

This item will deal with all of those repairs that do not fall
under the previous work items. These repairs shall only cover,
but not be limited to, such efforts as connector
repair/replacement, wiring or other minor work.

1.4 Response Times/Priority of Repairs:

Under normal operational conditions, the Contractor will have
four (4) hours form the time of being informed of site
problems, to send technical personnel to investigate under the
"Trouble Ticket" provided by 22 Wing ADSM. Technical
personnel will identify the nature of the problem and request
support if required under the appropriate Work Item. 22 Wing
will respond accordingly and record the requirement and if
necessary ship a spare kit or new antenna as required. Under
these conditions the Contractor's technical personnel will
repair the site as quickly as possible; scheduling it so that
CADRS requirements are not taking precedence over NavCan
issues.

1.4.1 During times of heightened security, 22 Wing personnel
will inform the Contractor's technical personnel of this fact
when advising of a "trouble Ticket". During these times of
heightened security, the Contractor's response time will be
shortened to one (1) hour. Should the Contractor not be able
to respond within this time, this fact must be conveyed to 22
Wing ADSM and a response time suitable to both parties must be
agreed to. The inability to respond within an hour must be an
exception and not a routine function. Once at the site DND
equipment repairs under heightened security must take priority
over NavCan equipment.

1.5 Replacement Kits:

When the Contractor is requested to repair a site under a
"Trouble Ticket" the technical personnel must first determine
that spares are necessary to complete the repair and they must
contact 22 Wing ADSM. They are to inform 22 Wing of the kit
required under either Work Item 1 or 2. A delivery destination
must be provided to 22 Wing who will make arrangements to ship
the kit to the location specified. Once the site has been
repaired, the technical personnel must return the kit/antenna
to the location specified by 22 Wing ADSM. Shipping costs to
and from the site will be covered by DND.

1.6 Contractor Authorities:

The Contractor must provide a contact list that clearly
identifies who should be called when problems exist at any
CADRS site. The contact list must provide DND with the
ability to reach the appropriate personnel 24 hours a day, 7
days a week and 365 days a year. Alternate contacts must also
be provided in the event that the primary contacts cannot be
reached.

1.6.1 The contact list must be amended whenever changes occur
and that information provided to 22 Wing ADSM first and then
the Contracting Authority and the DND PA.

2. Criteria for Assessment of the Statement of Capabilities

2.1 Minimum Essential Requirements

Any interested supplier must demonstrate by way of a Statement
of Capabilities that it meets the following requirements:

A) The Bidder is certified to maintain and hold CTAT/ITAR
equipment on behalf of DND; and
B) Bidder's technical personnel must:

• be qualified and experienced in maintaining DND Line-of-Site

radio systems,

• hold a DND Level II security clearance,
• have Transport Canada "Airside" security clearances (see

below for website information), and

• have the necessary NavCan security clearances (Note: If in

doubt, it is the Bidder's responsibility to contact NavCan for
information).

3. Applicability of Trade Agreements

This requirement comes under the Federal Supply Classification
(FSC) 5826, Radio Navigation Equipment, Airborne, and, as such,
is subject to the following Trade Agreements: AIT.

This requirement is not subject to the following Trade
Agreements.

• NAFTA;
• CPFTA; and
• CCFTA.

4. Justification, Name and Address of the Proposed Contractor

It is the government's intention to award a Contract to NAV
Canada (77 Metcalfe Street, Ottawa, Ontario, K1P 5L6), who is
the only known supplier capable of performing this work.

5. Government Contracts Regulations Exception(s)

The following exception to the Government Contracts Regulations
is invoked for this procurement under subsection 6(d) - "only
one person is capable of performing the work").

6. Exclusions and/or Limited Tendering Reasons

The following exclusion(s) and/or limited tendering reasons are
invoked under the section of the trade agreement(s) specified:
AIT / Article 506, para. 12(a).

7. Period of the Contract

The Work to be performed is for a three (3) year period. The
Contractor grants to Canada the irrevocable option to extend the
term of the Contract by up to two (2) additional one (1) year
period(s) under the same conditions. The Contractor agrees that,
during the extended period of the Contract, it will be paid in
accordance with the applicable provisions as set out in the
Basis of Payment.

You are hereby notified that the government intends to negotiate
with one firm only as identified above. Should you have any
questions concerning this requirement, contact the contracting
officer identified above.

An Advance Contract Award Notice (ACAN) allows departments and
agencies to post a notice, for no less than fifteen (15)
calendar days, indicating to the supplier community that it
intends to award a good, service or construction contract to a
pre-identified contractor. If no other supplier submits, on or
before the closing date, a Statement of Capabilities that meets
the requirements set out in the ACAN, the contracting authority
may then proceed with the award. However, should a Statement of
Capabilities be found to meet the requirements set out in the
ACAN, then the contracting authority will proceed to a full
tendering process.

Suppliers who consider themselves fully qualified and available
to provide the services/goods described herein, may submit a
statement of capabilities in writing to the contact person
identified in this Notice on or before the closing date of this
Notice. The statement of capabilities must clearly demonstrate
how the supplier meets the advertised requirements.

The PWGSC file number, the contracting officer's name and the
closing date of the ACAN must appear on the outside of the
envelope in block letters or, in the case of a facsimile
transmission, on the covering page.

The Crown retains the right to negotiate with suppliers on any
procurement.
