Material Handling Services

1. Purpose of an Advance Contract Notice (ACAN)

An Advance Contract Award Notice (ACAN) allows department and
agencies to post a notice, for no less than fifteen (15)
calendar days, indicating to the supplier community that it
intends to award a goods, service or construction contract to a
pre-identified supplier. If no other supplier submits, on or
before the closing date, a Statement of Capabilities that meets
the requirements set out in the ACAN, the contracting authority
may then proceed with the award. However, should a Statement of
Capabilities be found to meet the requirements set out in the
ACAN, then the contracting officer will proceed to a full
tendering process.

2. Definition of requirements and sole source justification

LOADING AND UN LOADING OF CARGO FLIGHTS FOR OP NUNALIVUT 13

A. GENERAL

1.1. Background. Op NUNALIVUT is an annual Joint Task Force
(North) (JTFN) sovereignty operation conducted in the High
Arctic. OpNUNALVUT 13 will be conducted in the area of Resolute
Bay, NU from 08 April 2013 to 05 May 2013.

1.2. Project Scope. As part of support to the Operation, JTFN
will require the contractor to provide Material Handling
Equipment (MHE) with driver, as and when requested, to
load/unload cargo from airplanes in Resolute Bay, NU from 04
February 2013 to 05 May 2013

B. REQUIREMENTS

2.1 General Requirements. The Contractor will provide equipment
and will be responsible for all delivery, setup, maintenance
activities and pick-up/return of equipment. This includes the
following:

2.1.1 The Contractors equipment and driver are required as
per schedule of arrival, departures and/or as and when requested
by DND representative.

2.1.2 The Contractor must supply all equipment, supplies and
consumables required to perform the services outlined in this
SOW;

2.1.3 The Contractor is responsible for any required positioning
of equipment to and from the Resolute Bay Airport Property as
required.

2.1.4 The contractor will provide a Point of Contact (POC) in
Resolute Bay including name and contact number within 72 hrs
after the award of this contract.

2.2 Technical Requirements. DND requires the contractor to
provide the Material handling equipment (MHE). The contractor
will ensure that :

2.2.1 The contractor will be required to provide MHE with driver
to load/unload different types of aircrafts.

2.2.2 The provided MHE must also be capable of moving full
aircraft pallets (108" by 88"), and other unpalletised
equipment, as required, to and from the warehouse to the tarmac
and around a camp on mixed terrain such as gravel, snow and hard
packed dirt surfaces.

2.2.3 The following types of aircraft are expected to be used to

transport personnel and equipment to and from
Resolute Bay:

CC-130 Hercules
CC-138 Twin Otter
Dash 8
Dash 7
DC 3 / BT- 67
CC-17 Globemaster III
Electra L188

2.2.4 All equipment must be equipped (at the time of delivery)
with amber rotating beacons which can be operated at all at all
times when on the airport grounds.

3. Trade Agreements

Article 1016, Section 2, (b) of the North American Free Trade
Agreement (NAFTA) and Article XV, Section 1 (b) of the World
Trade Organization Agreement of Government Procurement (WTO-AGP)
"...where, for works of art, or for reasons connected with the
protection of patents, copyrights or other exclusive rights, or
proprietary information or where there is an absence of
competition for technical reasons, the goods or services can be
supplied only by a particular supplier and no reasonable
alternative or substitute exists;"

Article 506, Section 12 (b) of the Agreement on Internal Trade
(AIT)
"...where there is an absence of competition for technical
reasons and the goods or services can be supplied only by a
particular supplier and no alternative or substitute exists;"

4. Government Contracts Regulations Exception
This contract is subject to subsection 6 (d) of the Government
Contracts Regulations, in that only one person or company is
capable of performing the contract.

to provide the services/goods described herein, may submit a
statement of capabilities in writing to the contact person
identified in this Notice on or before the closing date of this
Notice. The statement of capabilities must clearly demonstrate
how the supplier meets the advertised requirements.

The PWGSC file number, the contracting officer's name and the
closing date of the ACAN must appear on the outside of the
envelope in block letters or, in the case of a facsimile
transmission, on the covering page.

The Crown retains the right to negotiate with suppliers on any
procurement.

Documents may be submitted in either official language of Canada.
