1.0 SUBJECT
1.1 Environment Canada has an urgent and unforeseen requirement for the supply of all supervision, material, equipment, labour and transportation necessary to provide polychlorinated biphenyls (PCB) remediation services for the former Royal Canadian Navy (RCN) destroyer escort HMCS ANNAPOLIS, DDH 265 (the Vessel), which is presently moored at Gambier Island in Howe Sound, north of Horseshoe Bay, British Columbia.
2.0 BACKGROUND
2.1 Background information regarding this requirement is available via a Letter of Interest which was released on BuyandSell.gc.ca in relation to this requirement (https://buyandsell.gc.ca/procurement-data/tender-noti…).
2.2 Environment Canada has distributed a Request For Proposals for the Remediation Services for the ex-HMCS ANNAPOLIS, via email, to known interested suppliers, including all suppliers that corresponded with the Contracting Authority in response to the above mentioned Letter of Interest.
3.0 APPLICATION OF TRADE AGREEMENTS
3.1 Due to the urgency of this unforeseen situation, limited tendering provisions have been implemented as compliance with the open tendering provisions set out in these trade agreements would interfere with Canada’s ability to protect human, animal or plant life or health. As allowed under the below noted provisions, Canada will be reducing the bidding period.
3.2 Limited Tendering is being utilized for this requirement based on the following Trade Agreement references:
a) NAFTA exemption in accordance with Chapter 10, Article 1018 Exceptions. Para 2(b) and Article 1016 Para 2(c);
b) WTO-AGP exemption in accordance with WTO-AGP, Article XXIII Exceptions to the Agreement. Para 2; and
c) AIT exemption in accordance with Article 506, Para 11 (e).
4.0 MANDATORY SITE VISIT
4.1 It is mandatory that a Bidder or a representative of a Bidder visit the work site so that the Bidder may fully understand the scope of the work and the existing site conditions. Arrangements have been made for the site visit to be held on February 25, 2014. Bidders must communicate with the Contracting Authority no later than 2:00 PM PST, February 24, 2014 to confirm attendance and provide the names of the person(s) who will attend.
5.0 ADDITIONAL INFORMATION
5.1 It is strongly encouraged that any person or entity interested in bidding on this requirement contact the Contracting Authority as quickly as possible to obtain a solicitation package. Any such firms should take into consideration the above mandatory site visit requirement.

5.2 The Crown retains the right to negotiate with suppliers on any procurement.
