Nature of Requirements:
Advance Contract Award Notice (ACAN)
1. An ACAN is a public notice indicating to the supplier
community that a department or agency intends to award a
contract for goods, services or construction to a pre-identified
supplier, thereby allowing other suppliers to signal their
interest in bidding, by submitting a statement of capabilities.
If no supplier submits a statement of capabilities that meets
the requirements set out in the ACAN, on or before the closing
date stated in the ACAN, the contracting officer may then
proceed with the award to the pre-identified supplier.
2. Definition of the requirement
The Department of National Defence (DND) has entered into an
enterprise licensing arrangement with Pennant Canada Limited for
the Omega Product Support (OmegaPS) Suite of software products.
The OmegaPS Suite forms an integral part of the Defence Resource
Management Information System (DRMIS) total solution, which is
the department's central, enterprise resource planning,
automated system and is in the process of being implemented
within the department.
DND has a responsibility to provide ongoing and optimal
Logistics Support Analysis (LSA) capability - a process of
satisfying Integrated Logistics Support (ILS) requirements - to
DND's fleets of aircraft, ships, vehicles and weapon systems.
The LSA capability is performed by the fully integrated OmegaPS
software portion of DRMIS, the department's central automated
information system. Therefore, DND has a requirement to support
the use of OmegaPS Software suite within Assistant Deputy
Minister (Material) (ADM (Mat)).
The work will involve the following:
(a) Conduct installations of OmegaPS Suite software for ADM(Mat)
or other locations throughout DND;
(b) Provide support in the development of training material for
the DND user community;
(c) Conduct formal training courses for the DND user community
including DND instructors on the use of the OmegaPS Suite
software and any associated network administrative support;
(d) Provide on-site technical assistance for OmegaPS Suite
software to ADM(Mat) technical staff and at other DND locations;
(e) Provide both on-site and off-site specialist consultant
services in the area of Project Management, ILS and LSA,
specifically in the optimization of the use of OmegaPS suite as
a supportability tool within current and future DND environments;
(f) Assist ADM(Mat) in the development of new business processes
related to the use of the OmegaPS suite;
(g) Provide OmegaPS Suite software programming support services
to customize the software to meet evolving, unique to DND,
supportability software requirements; and
(h) Provide specialized data entry services for the OmegaPS
Complex Asset Supportability System (CASSi) interface.
3. Applicability of the trade agreement(s) to the procurement
This procurement is subject to the following trade agreements:
Agreement on Internal Trade (AIT);
World Trade Organization - Agreement on Government Procurement
(WTO-AGP); and
North American Free Trade Agreement (NAFTA)
4. Justification for the Pre-Identified Supplier
Government Contracts Regulations Exceptions: The following
exception to the Government Contracts Regulations is invoked for
this procurement under subsection subsection 6(d) - only one
person is capable of performing the work.
Exclusions and/or Limited Tendering Reasons: The following
exclusions and/or limited tendering reasons are invoked under
the:
Agreement on Internal Trade (AIT) - Article 506.12 (a);
World Trade Organization - Agreement on Government Procurement
(WTO-AGP) - Articles XV 1.(b) and (d); and
North American Free Trade Agreement (NAFTA) - Articles 1016.2
(b) and (d).
5. Ownership of Intellectual Property
Ownership of any Foreground Intellectual Property arising out of
the proposed contract will vest in the Contractor.
6. Period of the proposed contract or delivery date
The proposed contract is for a period of two years from date of
contract award (estimated to be September 1, 2014) with Canada
retaining irrevocable options to extend the Contract period for
up to three additional one year periods.
7. Estimated Cost of the Proposed Contract
$19,156,325.00 (Applicable taxes and option periods included).

9. Suppliers' right to submit a statement of capabilities
Suppliers who consider themselves fully qualified and available
to provide the goods, services or construction services
described in the ACAN may submit a statement of capabilities in
writing to the contact person identified in this notice on or
before the closing date of this notice. The statement of
capabilities must clearly demonstrate how the supplier meets the
advertised requirements.
10. Closing date for a submission of a statement of capabilities
The closing date and time for accepting statements of
capabilities is August 20, 2014 at 2:00 p.m. EDT.

You are hereby notified that the government intends to negotiate
with one firm only as identified above. Should you have any
questions concerning this requirement, contact the contracting
officer identified above.
An Advance Contract Award Notice (ACAN) allows departments and
agencies to post a notice, for no less than fifteen (15)
calendar days, indicating to the supplier community that it
intends to award a good, service or construction contract to a
pre-identified contractor. If no other supplier submits, on or
before the closing date, a Statement of Capabilities that meets
the requirements set out in the ACAN, the contracting authority
may then proceed with the award. However, should a Statement of
Capabilities be found to meet the requirements set out in the
ACAN, then the contracting authority will proceed to a full
tendering process.
Suppliers who consider themselves fully qualified and available
to provide the services/goods described herein, may submit a
statement of capabilities in writing to the contact person
identified in this Notice on or before the closing date of this
Notice. The statement of capabilities must clearly demonstrate
how the supplier meets the advertised requirements.
The PWGSC file number, the contracting officer's name and the
closing date of the ACAN must appear on the outside of the
envelope in block letters or, in the case of a facsimile
transmission, on the covering page.
The Crown retains the right to negotiate with suppliers on any
procurement.
