The National Capital Commission (NCC) has a requirement to award a contract to the Canadian Ice Carvers’ Society (CICS), a non-profit organization that oversees the annual Crystal Garden International Ice-Carving Competition in Ottawa. CICS will be approached on a sole source basis as they are the official Canadian Representative for the National Ice Carving Association and have a complete knowledge and understanding of Ice-carving Competition Rules and Guidelines and therefore can properly assess participants’ compliance to the rules during competition. CICS’ participation in other international ice-carving events provides them with the expertise to offer strategic recommendations to improve the competition process and contribute significantly to the overall success of the event. CICS encourages participation at the competition by managing relationships with existing members and developing contacts for potentially new members.
CICS’s responsibilities include the collection of the registration fees for the International Competition, the provision of international contacts to fulfill competition quota and event criteria by ensuring that the competition receives full recognition and representation; provision of technical advice, overall site planning, logistics, development of a work plan and the coordination and provision of meals for all carvers. CICS’ commitment to the event has been recognized internationally and has helped the competition become one of the top international ice-carving competitions attracting carvers from around the world. Additional responsibilities could include artists’ hospitality requirements during the event.
The duration of the contract will be for one (1) year with four (4) optional renewals of one (1) year. The estimated value for this contract is approximately $50,000 per year including HST.

NOTE: Following the adoption of the Economic Action Plan 2013 Act, No.1, (Bill C-60), S.C., 2013, c.33, (the ’’Act’’) implementing the 2013 Federal Budget, the National Capital Commission’s event and activity mandate will be transferred to the Department of Canadian Heritage. As provided for under section 219 of the Act, and to the extent that they relate to the activity and event mandate, the NCC’s assets will be transferred to and the NCC’s obligations will be assumed by Her Majesty in right of Canada, as represented by the Minister of Canadian Heritage, effective September 30, 2013. The contract resulting from this ACAN falls within the framework of the services that are being transferred to Canadian Heritage.
This requirement falls within the exemptions under the Government Contracts Regulations: 10.2.1(d) only one person or firm is capable of performing the contract and under the Agreement on Internal Trade (AIT), Chapter 5, Article 506, item 12 (a) to ensure compatibility with existing products, to recognize exclusive rights, such as exclusive licences, copyright and patent rights, or to maintain specialized products that must be maintained by the manufacturer or its representative.
The procurement process for this requirement is subject to Chapter 5 of the Agreement on Internal Trade (AIT).
An Advance Contract Award Notice (ACAN) allows departments and agencies to post a notice, for no less than fifteen calendar days, indicating to the supplier community that it intends to award a good, service or construction contract to a pre-identified contractor. If no other supplier submits, on or before the closing date, a statement of capabilities that meets the requirements set out in the ACAN, the competitive requirements of the government’s contracting policy have been met. Following notification to suppliers not successful in demonstrating that their statement of capabilities meets the requirements set out in the ACAN, the contract may then be awarded using the Treasury Board’s electronic bidding authorities. If other potential suppliers submit statements of capabilities during the fifteen calendar day posting period, and meet the requirements set out in the ACAN, the department or agency must proceed to a full tendering process on either the government’s electronic tendering service or through traditional means, in order to award the contract. Suppliers who consider themselves fully qualified and available to provide the services/goods described herein, may submit a statement of capabilities in writing to the contact person identified in this Notice on or before the closing date of this Notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements.
