An ACAN is a public notice indicating to the supplier community
that a department or agency intends to award a contract for
goods, services or construction to a pre-identified supplier,
thereby allowing other suppliers to signal their interest in
bidding, by submitting a statement of capabilities. If no
supplier submits a statement of capabilities that meets the
requirements set out in the ACAN, on or before the closing date
stated in the ACAN, the contracting officer may then proceed
with the award.
Requirement:
Environment Canada in Burlington, Ontario has a requirement for
the supply of Multinutrient Sonde Systems . (Qty 2)
Background
The Watershed Hydrology and Ecology Research Division of
Environment Canada is looking to purchase multinutrient sondes.
In particular, nitrogen and phosphorus are key elements in
controlling primary productivity in aquatic systems, and
monitoring their concentrations is important to assess the
health of the watershed. These sondes will be deployed in lakes,
rivers and streams, and are required to assess nutrient
concentrations and loadings in these systems.
Minimum Essential Requirements:
Must be deployable in remote sites, and stand alone, that is,
they should operate with batteries and log data internally, with
no electrical or data cables.
Must operate in as little as 30 cm of water
Sonde must be rugged, and able to withstand changing conditions
during long term deployments
Sonde, as a minimum must be able to measure phosphorus (usually
as orthophosphate), nitrogen (usually as nitrate) and
temperature. Optional: ability to measure other nutrients such
as silicate and ammonium
Sonde must be deployable for at least one month, with hourly
measurements of nitrate and phosphorus
The nutrient sensors must be able to measure in pristine as well
as polluted waters. Minimum detection limits should be at or
less than 0.005 mg/L for nitrate and phosphorus.
Sonde must be deployable from 0 to - 40° C.
Data must be downloadable from the field, either using a hand
held data logger, or lap top computer.

Trade Agreements:
The requirement is subject to the following the North American
Free Trade Agreement (NAFTA), the Canada-Peru Free Trade
Agreement and the Agree on Internal Trade (AIT) however it is
proposed to invoke limited tendering reasons in accordance with
the following:

where, for works of art, or for reasons connected with the
protection of patents, copyrights or other exclusive rights, or
proprietary information or where there is an absence of
competition for technical reasons, the goods or services can be
supplied only by a particular supplier and no reasonable
alternative or substitute exists;
AIT: Article 506, (12b)
where there is an absence of competition for technical reasons
and the goods or services can be supplied only by a particular
supplier and no alternative or substitute exists; (CAP code
Delivery date required: On or before 28 March 2013.
The estimated cost of the contract is $57,250.00 + HST if
applicable.
Sole Source Justification.
The instruments requested is a very specific instrument which
can measure nitrate, phosphate, amonia and silicate
simultaneously, and in situ in aquatic environments. The
Envirotech EcoLab 2 is the only known provider of a
multinutrient freshwater in situ field analyzer within North
America.

"Suppliers who consider themselves fully qualified and available
to provide the services and/or goods described herein, may
submit a statement of capabilities in writing to the contact
person identified in this notice on or before the closing date
of this notice. The statement of capabilities must clearly
demonstrate how the supplier meets the advertised requirements."

with one firm only as identified above. Should you have any
questions concerning this requirement, contact the contracting
officer identified above.
An Advance Contract Award Notice (ACAN) allows departments and
agencies to post a notice, for no less than fifteen (15)
calendar days, indicating to the supplier community that it
intends to award a good, service or construction contract to a
pre-identified contractor. If no other supplier submits, on or
before the closing date, a Statement of Capabilities that meets
the requirements set out in the ACAN, the contracting authority
may then proceed with the award. However, should a Statement of
Capabilities be found to meet the requirements set out in the
ACAN, then the contracting authority will proceed to a full
tendering process.
Suppliers who consider themselves fully qualified and available
to provide the services/goods described herein, may submit a
statement of capabilities in writing to the contact person
identified in this Notice on or before the closing date of this
Notice. The statement of capabilities must clearly demonstrate
how the supplier meets the advertised requirements.

closing date of the ACAN must appear on the outside of the
envelope in block letters or, in the case of a facsimile
transmission, on the covering page.
The Crown retains the right to negotiate with suppliers on any
procurement.
