An Advanced Contract Award Notice (ACAN) must be prepared in both official languages. Below is a model that must be used by contracting officers for the preparation of an ACAN. The blocks include guidance for its use as well as examples for some of the items listed.
1. Advance Contract Award Notice (ACAN)
An ACAN is a public notice indicating to the supplier community that a department or agency intends to award a contract for goods, services or construction to a pre-identified supplier, thereby allowing other suppliers to signal their interest in bidding, by submitting a statement of capabilities. If no supplier submits a statement of capabilities that meets the requirements set out in the ACAN, on or before the closing date stated in the ACAN, the contracting officer may then proceed with the award to the pre-identified supplier.
2. Definition of the requirement
Agriculture and Agri-Food Canada (AAFC), Swift Current Research and Development Centre, Swift Current, Saskatchewan has a requirement for the supply of one LabSpec 4 Standard-Res portable field-ready spectrometer used for NIR radiance measurement, one 1.5 meter Fiber Optic Jumper Cable, and one Plant Probe Kit.
This equipment is required to enable efficient, low cost screening of fusarium resistance (low DON [deoxynivalenol] accumulation) in wheat breeding lines under field conditions. Improving grain quality is one of the major aims for AAFC scientists. Fusarium infected wheat seeds accumulate DON that can result in total rejection of the crop meant for food purpose and downgrade grains to feed use. Apart from DON, this instrument can also detect other components such as N, protein, pigments etc. in wheat seeds and other plant parts.
The LabSpec 4 Standard-Res is a portable field-ready spectrometer used for NIR radiance measurements with a spectral range of 350 - 2500 nm and a spectral resolution of 3 nm @ 700 nm and 10 nm @ 1400/2100 nm. The LS4Si-C0XXA0 model includes a 50W integrated light source and WIFI.
Standard accessories include a rigid foam-lined Pelican carrying case, Spectralon white reference panel, fiber optic cable inspection magnifier, 12VDC 70W power supply, NIMH battery and charger, 20' car charge adapter, and IndicoProdata collection/modeling/operating software.
3. Criteria for assessment of the Statement of Capabilities (Minimum Essential Requirements)
Any interested supplier must demonstrate by way of a statement of capabilities that its equipment meets the following requirements:
1. Existing technology: The instrument must be a recent version and in the market for a minimum of one (1) year. The model must be currently in production.
2. Instrument must be configured for wide range near Infrared (NIR) spectrometery and include all necessary components for measuring spectral indices in plants.
3. Instrument must have full portability for field use, not heavier than 6 kg excluding laptop computer.
4. Wavelength range must be, at a minimum, between 350 and 2500 nm (nanometers) and operate in reflectance measurement mode. Resolution of 3 nm @700 nm and 10 nm @1400/2100 nm.
5. Must be Silicon (350-1100 nm) and Lead Sulfide (1100-2500) detectors. The signal to noise* ratio must be less than 50 micro absorbance units (au) in the 400-700 region and less than 20 au in the 700-2500 region. (*Noise=root mean square for 10 co-added, 10 second scans).
6. The instrument software must be 100% compatible to get equations transferred from FOSS NIR system.
7. Instrument must have an integrated internal light source for measurements of samples with all the choices of fiber optic probes and accessories that do not have their own light source.
8. Must have capability to detect DON (deoxynivalenol) toxin (as well as other components such as N, protein, pigments etc.) in wheat seeds, slurries and other plant parts.
9. Instrument must have ability to accept various probes and accessories for analysis of different target samples such as single seed, slurry, powder, leaves, stem.
10. Instrument must have flexibility to accept user defined equations for various target samples as against fixed measurements with in-built indices.
11. The equipment must be CSA approved upon delivery to Agriculture and Agri-Food Canada (AAFC).
12. Instrument must have computer and software for data acquisition with tools for data analysis, reporting and exporting.
13. Software must be included with the system that includes being capable of routine analysis, calibrations and creating scripts.
14. Software must provide complete control of the instrument and accessories.
15. Software must provide tools for creating methods and data analysis, reporting and exporting.
16. Software must be compatible with Windows 7, 64 bit.
17. Must include warranty for equipment of one year for parts and onsite service.
18. Must provide equipment installation and training for two AAFC employees.
19. Must provide telephone and/or email support and troubleshooting of equipment for the life of the equipment.
20. Must provide support for service and repairs.
21. Packaging and shipping are to be in accordance with the industry standard for all items in order to ensure their safe arrival at destination. Packing slips shall accompany each shipment.
4. Government Contracts Regulations Exception(s)
The following exception(s) to the Government Contracts Regulations is invoked for this procurement under subsection 6 (d) - only one person is capable of performing the contract.
5. Exclusions and/or Limited Tendering Reasons
The following exclusion(s) and/or limited tendering reasons are invoked under the:
- Canadian Free Trade Agreement (CFTA) Article 513, reason 1.b (i) and (v).
- North American Free Trade Agreement (NAFTA) Article 1016 2(b).
6. Period of the proposed contract or delivery date
All deliverables must be received on or before March 29, 2018.
7. Cost estimate of the proposed contract
The estimated value of the contract is $ 51,330.00 CAD (GST/HST extra).
8. Name and address of the pre-identified supplier

You are hereby notified that the government intends to negotiate with one firm only as identified above. Should you have any questions concerning this requirement, contact the contracting officer identified above.
An Advance Contract Award Notice (ACAN) allows departments and agencies to post a notice, for no less than fifteen (15) calendar days, indicating to the supplier community that it intends to award a good, service or construction contract to a pre-identified contractor. If no other supplier submits, on or before the closing date, a Statement of Capabilities that meets the requirements set out in the ACAN, the contracting authority may then proceed with the award. However, should a Statement of Capabilities be found to meet the requirements set out in the ACAN, then the contracting authority will proceed to a full tendering process.
Suppliers who consider themselves fully qualified and available to provide the services/goods described herein, may submit a statement of capabilities in writing to the contact person identified in this Notice on or before the closing date of this Notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements.
The PWGSC file number, the contracting officer's name and the closing date of the ACAN must appear on the outside of the envelope in block letters or, in the case of a facsimile transmission, on the covering page.
The Crown retains the right to negotiate with suppliers on any procurement.
Documents may be submitted in either official language of Canada.
