Purpose of an Advance Contract Notice (ACAN)
An Advance Contract Award Notice (ACAN) allows department and
agencies to post a notice, for no less than fifteen (15)
calendar days, indicating to the supplier community that it
intends to award a goods, service or construction contract to a
pre-identified supplier. If no other supplier submits, on or
before the closing date, a Statement of Capabilities that meets
the requirements set out in the ACAN, the contracting authority
may then proceed with the award. However, should a Statement of
Capabilities be found to meet the requirements set out in the
ACAN, then the contracting officer will proceed to a full
tendering process.
2. Definition of requirements and sole source justification
The Prairie and Northern Air Quality Science Unit of the
Department of Environment Canada has a requirement for the
supply and delivery of 3 Tekran Mercury Vapor Primary
Calibration Sources Model 2505 and parts and accessories for
Tekran Mercury Analyzers.
The Prairie & Northern Region Air Quality Science Unit
(PNR-AQSU) currently has 8 Tekran Total Gaseous Mercury (TGM)
analyzers. Three of the analyzers are currently monitoring
mercury at three different locations in the PNR (2 are in the
oil sands region and 1 is in Manitoba). The Environment Canada
Canadians Atmospheric Mercury Measurement Network (CAM Net)
stations also use the Canadian-made Tekran analyzers to monitor
TGM concentrations. The CAM Net sites are in part used to
improve the current understanding of the atmospheric transport,
transformation and removal processes of elemental mercury and
its ecologically significant contributions released into the
environment. In order to maintain national consistency, it is
necessary for PNR-AQSU to continue to use the Tekran
instruments.
PNR-AQSU now requires various equipment to enable the continued
successful operation of the Tekran analyzers. Calibration and
operation of the Tekran analyzers would be impossible with any
other equipment other than Tekran equipment.
In order to maintain national consistency, it is necessary for
PNR-AQSU that these new Calibration Sources and parts are
compatible with the current system.

4. Government Contracts Regulations Exception
This contract is subject to subsection 6 (d) of the Government
Contracts Regulations, in that only one person or company is
capable of performing the contract.

8. Submission of Statement of Capabilities by Suppliers
Suppliers who consider themselves fully qualified and available
to provide the services/goods described herein, may submit a
statement of capabilities in writing to the contact person
identified in this Notice on or before the closing date of this
Notice. The statement of capabilities must clearly demonstrate
how the supplier meets the advertised requirements.
The PWGSC file number, the contracting officer's name and the
closing date of the ACAN must appear on the outside of the
envelope in block letters or, in the case of a facsimile
transmission, on the covering page.
The Crown retains the right to negotiate with suppliers on any
procurement.
Documents may be submitted in either official language of Canada.
