An ACAN is a public notice indicating to the supplier community
that a department or agency intends to award a contract for
goods, services or construction to a pre-identified supplier,
thereby allowing other suppliers to signal their interest in
bidding, by submitting a statement of capabilities. If no
supplier submits a statement of capabilities that meets the
requirements set out in the ACAN, on or before the closing date
stated in the ACAN, the contracting officer may then proceed
with the award to the pre-identified supplier.
1. Definition of requirement:
Public Works and Government Services Canada (PWGSC) on behalf of
the Canadian Forces Health Services Group (CFHSG) of the
Department of National Defence (DND) intends to solicit a bid
and negotiate a contract with PEPID LLC for the provision of
subscription services of an electronic medical software and drug
support database program for physician assistants.
2. Criteria for assessment of the Statement of Capabilities
Minimum essential requirements:
(a) The software must be compatible with mobile devices such as
smart phones, personal digital assistants.
(b) The software must be compatible with the duties of a
Canadian physician assistant.
(c) Crucial periodic updates for the software must be free of
charge.
(d) The software must allow the user to access critical medical
information without having to read through pages of textbook
references.
(e) The software must allow the user to access to critical
Canadaian medication information without having to read through
pages of textbook references.
(f) The software must allow the user to access lifesaving
protocols without having to read through pages of textbook
references.
(g) The software must allow the user to access critical
laboratory values during emergencies without having to read
through pages of textbook references.
(h) The software must allow the user to access a body surface
calculator (used in cases of severe burns).
(i) The software must allow the user to access numerous
cardiology strips without having to read through pages of
textbook references.
(j) The software must allow the user to access comprehensive
content of diseases, trauma, pathologies, diagnosis, treatment
and disposition.
(k) The software must allow the user to access strong content on
pediatric conditions and management.
(l) The software must allow the user to access a toxicology
section.
(m) The software must allow the user to access complete medical
content on anatomy and physiology of the human body.
(n) The software must provide descriptive and high resolution
illustrations of its medical content.
(o) The software must allow the user to access extensive
medication content.
(p) The software must allow the user to access US and Canadian
pharmacological equivalencies.
(q) The software must allow the user to access information on
Canadian medications.
(r) The software must have IV compatibility.
(s) The software must allow the user to access information on
extensive medication management (for cases such as overdose,
contraindication).
(t) The software must provide numerous calculators (such as for
medications, IV rates, burns, dosage, laboratory tables).
3. Applicability of the trade agreement(s) to the procurement:
This requirement is subject to the following trade agreements:
North American Free Trade Agreement (NAFTA)
4. Comprehensive Land Claims Agreement(s):
This requirement is not subject to CLCA because no procurement
is conducted in the area of land claims.
5. Justification for the Pre-Identified Supplier:
The proposed Contractor has proprietary rights to the PEPID
software. The proposed supplier is the only authorized agent to
sell their subscription support services for the product.
6. Government Contracts Regulations Exception(s):
The following exception to the Government Contracts Regulations
is invoked for this procurement under subsection 6(d) - "only
one person is capable of performing the work".
7. Exclusions and/or Limited Tendering Reasons:
The following exclusion(s) and/or limited tendering reasons are
invoked under the section of the trade agreement(s) specified:
North American Free Trade Agreement (NAFTA) - Article 1016 (b).
8. Ownership of Intellectual Property:
Ownership of any Foreground Intellectual Property arising out of
the proposed contract will vest in the Contractor.
9. The period of the proposed contract:
The proposed contract is for a period of 3 years with the option
to extend the proposed contract period by 2 additional 1-year
periods.

Suppliers who consider themselves fully qualified and available
to provide the services and/or goods described herein, may
submit a statement of capabilities in writing to the contact
person identified in this notice on or before the closing date
of this notice. The statement of capabilities must clearly
demonstrate how the supplier meets the advertised requirements.
12. The closing date for submission of capabilities:
The closing date and time for accepting statements of
capabilities is April 15, 2013.
13. Inquiries and submission of statements of capabilities:
The PWGSC file number (381zm.W3931-120133), the contracting
officer's name and the closing date of the ACAN must appear on
the outside of the envelope in block letters or, in the case of
a facsimile transmission, on the covering page.

An Advance Contract Award Notice (ACAN) allows departments and
agencies to post a notice, for no less than fifteen (15)
calendar days, indicating to the supplier community that it
intends to award a good, service or construction contract to a
pre-identified contractor. If no other supplier submits, on or
before the closing date, a Statement of Capabilities that meets
the requirements set out in the ACAN, the contracting authority
may then proceed with the award. However, should a Statement of
Capabilities be found to meet the requirements set out in the
ACAN, then the contracting authority will proceed to a full
tendering process.
Suppliers who consider themselves fully qualified and available
to provide the services/goods described herein, may submit a
statement of capabilities in writing to the contact person
identified in this Notice on or before the closing date of this
Notice. The statement of capabilities must clearly demonstrate
how the supplier meets the advertised requirements.
