1. Advance Contract Award Notice (ACAN) Explanation
An ACAN is a public notice indicating to the supplier community
that a department or agency intends to award a contract for
goods, services or construction to a pre-identified supplier,
thereby allowing other suppliers to signal their interest in
bidding, by submitting a statement of capabilities. If no
supplier submits a statement of capabilities that meets the
requirements set out in the ACAN, on or before the closing date
stated in the ACAN, the contracting officer may then proceed
with the award to the pre-identified supplier.
2. Definition of the requirement
Environment Canada's (EC) Air Quality Research division requires
one (1) Semi-Volatile Organic Aerosol Sampler (SVOC) for
analyzing atmospheric gas and particle partitioning. Unlike
conventional methods of air sampling this system must have the
capability to collect the vapour phase first followed by the
particulate phase in order to obtain a more accurate phase
distribution of semi volatile organic compounds in air samples.
The vapour phase must be collected in a 8-channel glass denuder
which provides large surface area will help increase the
collection capability. The design of the filter pack (particle
collector) must consist of multiple filter holders in order to
detect air breakthrough and to ensure sample integrity.
The SVOC sampler is a complete system containing the following
parts:
1 x #30 Aluminium cyclone
1 x Gooseneck Adapter
4 x Aluminium Adapter
2 x 8 channel glass annular denuder
1 x Aluminium coupler
1 x Aluminium filter pack
1 x Teflon adapter
1 x Insulated Sampling Box
1 x Flow controller and pump with computerized data acquisition
system
Contractor must supply and deliver one (1) Semi-Volatile Organic
Aerosol Sampler (SVOC) to Downsview, Ontario by March 15, 2014
Contractor must also provide twelve (12) months of maintenance
and warranty service commencing from the date of delivery
acceptance by EC Project Authority for the SVOC.
3. Criteria for assessment of the Statement of Capabilities
3.1 Minimum Essential Requirements
Any interested supplier must demonstrate by way of a statement
of capabilities that its product meets the following
requirements:
I. This system must collect the atmospheric gas phase before
collecting the particle phase to avoid sampling artifact;
II. This system must have a 8 channel glass denuder for sampling
the vapour phase in order to provide a large surface area to
increase the collection capability. i.e increase the detection
capability;
III. This system must have at least 3 filter pack holders
(particle collector) to ensure sample integrity is maintained
and any breakthrough can be detected;
IV. This system must have a computerized flow controller in
order to program an accurate range of air flow;
V. Must have a computerized data acquisition system in order to
detect changes in air flow during sampling run; and
VI. Must have a sampling box to house the denuder system in
order to minimize volatilization of the target compounds during
sampling. The sampling box must also be able to protect the
denuder sampler during environmental conditions such as rain,
snow and extreme low temperature.
4. Applicability of the trade agreement(s) to the procurement
This procurement is subject to the following trade agreements:
(a) Agreement on Internal Trade (AIT); and
(b) North American Free Trade Agreement (NAFTA).
5. Justification for the Pre-Identified Supplier
URG Corporation of Chapel Hill, North Carolina, USA is the only
manufacturer and sole distributor of the URG-3000DB which is the
only known Semi-Volatile Organic Aerosol Sampler equipped with 8
channel glass denuders which meets our minimum performance
specification.
6. Government Contracts Regulations Exception(s)
The following exception to the Government Contracts Regulations
is invoked for this procurement under section 10.2.1 subsection
6 (d), only one person or firm is capable of performing the
contract; for the patent or copyright requirements, or technical
compatibility factors and technological expertise.
7. Exclusions and/or Limited Tendering Reasons
The following exclusion(s) and/or limited tendering reasons are
invoked under the section of the trade agreements specified:
(a) Agreement on Internal Trade (AIT) - Article 506.12 (b),
where there is an absence of competition for technical reasons
and the goods or services can be supplied only by a particular
supplier and no alternative or substitute exists; and
(b) North American Free Trade Agreement (NAFTA) Article 1016.2
(b), where, for works of art, or for reasons connected with the
protection of patents, copyrights or other exclusive rights, or
proprietary information or where there is an absence of
competition for technical reasons, the goods or services can be
supplied only by a particular supplier and no reasonable
alternative or substitute exists.
8. The Delivery Date
The product must be delivered on or prior to March 15, 2014.

Suppliers who consider themselves fully qualified and available
to provide the goods, services or construction services
described in the ACAN may submit a statement of capabilities in
writing to the contact person identified in this notice on or
before the closing date of this notice. The statement of
capabilities must clearly demonstrate how the supplier meets the
advertised requirements.
11. Closing date for a submission of a statement of capabilities
The closing date and time for accepting statements of
capabilities is November 8, 2013 at 2:00 p.m. EST.

with one firm only as identified above. Should you have any
questions concerning this requirement, contact the contracting

An Advance Contract Award Notice (ACAN) allows departments and
agencies to post a notice, for no less than fifteen (15)
calendar days, indicating to the supplier community that it
intends to award a good, service or construction contract to a
pre-identified contractor. If no other supplier submits, on or
before the closing date, a Statement of Capabilities that meets
the requirements set out in the ACAN, the contracting authority
may then proceed with the award. However, should a Statement of
Capabilities be found to meet the requirements set out in the
ACAN, then the contracting authority will proceed to a full
tendering process.
Suppliers who consider themselves fully qualified and available
to provide the services/goods described herein, may submit a
statement of capabilities in writing to the contact person
identified in this Notice on or before the closing date of this
Notice. The statement of capabilities must clearly demonstrate
how the supplier meets the advertised requirements.
The PWGSC file number, the contracting officer's name and the
closing date of the ACAN must appear on the outside of the
envelope in block letters or, in the case of a facsimile
transmission, on the covering page.
The Crown retains the right to negotiate with suppliers on any
procurement.
