DND is retendering this requirement using the legitimate objection exception to the Canadian Free Trade Agreement (CFTA). While the trade agreements require Canada to allow equivalent products, the trade agreements also allow for exceptions to this rule for legitimate objectives. Under the CFTA a legitimate objective includes: public security and safety and also the protection of the health, safety and well-being of workers.
The aviation filters on this requirement are in support of Royal Canadian Air Force (RCAF) airplanes.
The RCAF defends and protects Canadian and North American airspace in partnership with the United States. The RCAF also contributes to international peace and security. DND policy does not allow DND to mix different brands of aviation filters. Specifically, these filters help to ensure fuel cleanliness and therefore, accepting equivalents could pose safety concerns for the airplanes, crew, and other passengers. Furthermore, a significant amount of work would be required to prepare the airplanes for equivalent filters, which is not feasible and which would require downtime of the aviation refuelling capability.
It is with these reasons that Canada will be using the legitimate objective exception and will not accept equivalent products for this requirement.
The Crown retains the rights to negotiate with suppliers on any procurement.
