Nature of Requirements:
Evaporative Light Scattering Detector
1. ACAN Explanation
An Advance Contract Award Notice (ACAN) allows departments and
agencies to post a notice, for no less than fifteen (15)
calendar days, indicating to the supplier community that it
intends to award a good, service or construction contract to a
pre-identified contractor. If no other supplier submits, on or
before the closing date, a Statement of Capabilities that meets
the requirements set out in the ACAN, the contracting authority
may then proceed with the award.
2. Definition of Requirement
Health Canada, Organic Residues Laboratory, Toronto, Ontario
requires the supply and delivery of one (1) complete and fully
functional Evaporative Light Scattering Detector (ELSD) for the
qualitative and quantitative analysis compounds that exhibit
poor to no UV/VIS response and analytes that do not ionize well
under mass spectrometry.
Delivery is required on or before March 28, 2013.
3. Criteria for Assessment of the Statement of Capabilities
3.1 Minimum Essential Requirements:
Any interested supplier must demonstrate by way of a statement
of capabilities that its product meets the following
requirements:
The Evaporative Light Scattering Detector (ELSD) must meet the
following mandatory specifications:
A. Instrument:
1. The ELSD must be specifically designed to work under Water
Acquity Ultra Performance Liquid Chromatography (UPLC) and must
be 100% compatible with the hardware.
2. The detector must be specifically designed for the analysis
of compounds that have poor to no UV/VIS and analytes that do
not ionize well under mass spectrometry.
3. The detector must be stackable on top of other Water Acquity
UPLC detectors due to space considerations.
4. the detector must be fully automated and controlled by Waters
Empower II data control system.
5. the detector must come with build-in I/O events that enables
auto zero, inject start and chart mark and for output where it
must enable stoppage of flow, switches pump flow off/on gas
pressure fault. It must have programmable contact closure
enabled by time or threshold signal.
6. The detector must be operable between 4 to 40 degrees C.
7. Nebulizer must be front mounted for easy accessibility.
8. Temperature control nebulizer chamber must be adjustable from
0 to 100%.
9. Drift tube temperature must be adjustable from ambient to 80
degrees C.
10. Gas supplying outlet must supply at least 65 psi.
11. Temperature Range of Drift tube must be adjustable with 0.1
degree C increments. Feedback must also be displayed.
12. Lamp must be easily accessible, replaceable and easily
installable by lab personnel.
13. Lamp source must have a life greater than 2000 hours and
replacement is readily available when needed.
14. Detector must have a photomultiplier tube with digital
signal processing.
15. Detector must be able to self diagnostic and PMT is
calibrated and normalized at startup.
16. Detector must be operable within range 0.1-2000 Light
scattering units.
17. Detector must have adjustable attenuation settings.
18. Detector must be able to handle eluent flow rates from 0.1
ml/min to at least 2 ml/min.
19. Detector must require no more than 1 hour warm up with
minimal equilibration time.
20. Detector must be able to process fast data output rates up
to 80 Hz.
B. Installation
1. Detector must come with all power cords, cables and other
required accessories for proper installation.
2. Instructions for preparation of site must be provided to
laboratory at least 15 days before installation.
3. Detector must be properly installed by a certified/qualified
technician/engineer.
4. Detector must be installed in manner to ensure that no
hazardous gas or particles escape into the laboratory atmosphere.
5. Detector must be configured to existing Waters Acquity UPLC
with Empower II data control system.
6. Training on the use and maintenance of the detector must be
provided.
7. The detector must come with a user's manual covering both
operation and maintenance procedures in a clear and concise
manner.
4. Applicability of Trade Agreements
This procurement is subject to the following trade agreements:
Agreement on Internal Trade (AIT)
North American Free Trade Agreement (NAFTA)
5. Justification for the Pre-Identified Supplier
Health Canada requires a Evaporative Light Scattering Detector
that works with the Waters ACQUITY UPLC system. The proposed
manufacturer's (Waters) Evaporative Light Scattering Detector
(ELSD) is specifically designed to work with the Waters ACQUITY
UPLC system and controlled by the Waters Empower II software.
Health Canada currently possesses three Waters ACQUITY UPLCs and
one which controls the Empower II software, thus the Waters ELSD
is entirely compatible with the existing equipment.
Waters Limited is the manufacturer and the only known
distributor of this instrument.
6. Government Contracts Regulations Exception
The following exception to the Government Contracts Regulations
is invoked for this procurement under subsection 6(d) - "Only
one person or firm is capable of performing the contract"; for
patent or copyright requirements, or technical compatibility
factors and technological expertise."
7. Exclusions and/or Limited Tendering Reasons
The following exclusion(s) and/or limited tendering reasons are
invoked under the section of the trade agreement(s) specified:
Agreement on Internal Trade (AIT) - Article 506.12 (b) "where
there is an absence of competition for technical reasons and the
goods or services can be supplied only by a particular supplier
and no alternative or substitute exists."
North American Free Trade Agreement (NAFTA) - Article 1016.2
(b), "where, for works of art, or for reasons connected with the
protection of patents, copyrights or other exclusive rights, or
proprietary information or where there is an absence of
competition for technical reasons, the goods or services can be
supplied only by a particular supplier and no reasonable
alternative or substitute exists." and Article 1016.2 (d)
"additional deliveries by the original supplier intended either
as parts replacement for existing supplies or installation, or
the extension of existing supplies, services, or installations
where a change of supplier would compel the entity to procure
equipment or services not meeting requirements of
interchangeability with already existing equipment or services,
including software to the extent that the initial procurement of
the software was covered by this Chapter".
8. The Delivery Date
Delivery is required on or before March 28, 2013.

10. Suppliers' right to submit a statement of capabilities
Suppliers who consider themselves fully qualified and available
to provide the goods and services described in the ACAN, may
submit a statement of capabilities in writing to the contact
person identified in this notice on or before the closing date
of this notice. The statement of capabilities must clearly
demonstrate how the supplier meets the advertised requirements.
11. The closing date for a submission of a statement of
capabilities:
The closing date and time for accepting statement of
capabilities is 11 February 2013 at 2:00 p.m. EST.

with one firm only as identified above. Should you have any
questions concerning this requirement, contact the contracting
officer identified above.

identified in this Notice on or before the closing date of this
Notice. The statement of capabilities must clearly demonstrate
how the supplier meets the advertised requirements.
The PWGSC file number, the contracting officer's name and the
closing date of the ACAN must appear on the outside of the
envelope in block letters or, in the case of a facsimile
transmission, on the covering page.
The Crown retains the right to negotiate with suppliers on any
procurement.
