Trade Agreement: Agreement on Internal Trade (AIT)
Tendering Procedures: Generally only one firm has been invited to bid
Non-Competitive Procurement Strategy: Exclusive Rights
Comprehensive Land Claim Agreement: No
Vendor Name and Address:
Levitt-Safety Limited
2044 32iem Avenue
Lachine Quebec
Canada
H8T3H7
Nature of Requirements:

RAMAN/INFRARED combined chemical identifier

1. Advance Contract Award Notice (ACAN)

An ACAN is a public notice indicating to the supplier community that a department or agency intends to award a contract for goods, services or construction to a pre-identified supplier, thereby allowing other suppliers to signal their interest in bidding, by submitting a statement of capabilities. If no supplier submits a statement of capabilities that meets the requirements set out in the ACAN, on or before the closing date stated in the ACAN, the contracting officer may then proceed with the award to the pre-identified supplier.

2. Definition of the requirement

The Department of National Defence (DND) has a requirement for a single chemical identification system capable of identifying the chemical composition of liquid and solid samples via both Raman and infrared spectroscopic techniques. Using both technologies in separate instruments to achieve the same technological capability defeats the operational and logistic benefits of carrying a single system and its requisite consumables when on deployed operations. The single instrument will reduce the weight and volume of the current chemical identification capability by 85% and 95% respectively. Attempting to fulfill this combined requirement via separate instruments, or a single Raman or infrared technology will result in inefficiencies in terms of training, interoperability and sustainment.

3. Criteria for assessment of the Statement of Capabilities (Minimum Essential Requirements)

Any interested supplier must demonstrate by way of a statement of capabilities that it meets the following requirements:

a) Equipment has both Raman light scattering and Attenuated Total Resonance (ATR) Fourier-Transform Infrared (FTIR) technologies combined into a single instrument;

b) Equipment is hand-held and weighs no more than 2kg;

c) Data output must be compatible with the existing analysis software (Omnic?) used by DND;

d) Equipment is ruggedized which precludes the requirement for regular re-alignment prior to analysis:

i. Withstand high temperatures in accordance with MIL-STD-810G 501.5G (refer to Procedure I - Storage: Up to -30°C and Procedure II - Operation: Up to +40°C);

ii. Withstand low temperatures in accordance with MIL-STD-810G 502.05G (refer to Procedure I - Storage: Up to -30°C and Procedure II - Operation: Up to -20°C);
iii. Withstand exposure to sand and dust in accordance with MIL-STD-810G 510.5 (refer to Procedure I- Blowing Dust and Procedure II - Blowing Sand);

iv. Withstand water ingress in accordance with MIL-STD-810G 512.5 (refer to Procedure I - Immersion);

v. Withstand vibration in accordance with MIL-STD-810G 514.6 (refer to Procedure II - Loose Cargo Transportation); and

vi. Withstand shock in accordance with MIL-STD-810G 516.6 (refer to Functional Test for Ground Equipment, Procedure I - Functional Shock).

e) Equipment is currently commercially and readily available.

4. Justification for the Pre-Identified Supplier

The Gemini? manufactured by Thermo-Scientific is the only commercially and readily available instrument that combines both Raman light scattering and ATR-FTIR technologies in a single platform and user interface. Leavitt Safety is the sole-distributer of Thermo-Scientific equipment in Canada.

5. Government Contracts Regulations Exception(s)

The following exception(s) to the Government Contracts Regulations is invoked for this procurement under subsection 6(d) - "only one person is capable of performing the work".

6. Exclusions and/or Limited Tendering Reasons

The following exclusion(s) and/or limited tendering reasons are invoked under the:
o Agreement on Internal Trade (AIT) - Article(s) 506.12(b) ?where there is an absence of competition for technical reasons and the goods or services can be supplied only by a particular supplier and no alternative or substitute exists?;
o North American Free Trade Agreement (NAFTA) - Annex 1001.1b-1, Section B,FSC code: 66 (6665 Hazardous-detecting instruments and apparatus);
o World Trade Organization - Agreement on Government Procurement (WTO-AGP) - Article(s) XXIII, Section B, FSC code: 66 (6665 Hazardous-detecting instruments and apparatus).

7. Ownership of Intellectual Property

Ownership of any Foreground Intellectual Property arising out of the proposed contract will vest in the Contractor.

The Contract includes an option to purchase additional Gemini systems within 24 months of Contract award. The Contract also includes options for additional training and In-Service Support.

9. Cost estimate of the proposed contract
