UPDATE OF EXISTING DRAWINGS AND SPECIFICATIONS, MODIFICATIONS
AND ADDITIONS - WHARF 95
1. An ACAN is a public notice indicating to the supplier
community that a department or agency intends to award a
contract for goods, services or construction to a pre-identified
supplier, thereby allowing other suppliers to signal their
interest in bidding by submitting a statement of capabilities.
If no supplier submits a statement of capabilities that meets
the requirements set out in the ACAN, on or before the closing
date stated in the ACAN, the contracting officer may then
proceed with the issuance to the pre-identified supplier.
2. The Department of Fisheries and Oceans has a requirement for
the services of a consultant to update drawings and
specifications for a bid originally produced by Genivar Inc in
2009 to rebuild Wharf95 at the Canadian Coast Guard base in
Québec. The work will require the following:
Validation and modification of drawings and specifications for
the 2013 update;
Evaluation of the work schedule and revision of cost estimates.
The project also involves modifying the existing designs and
making additions to the original design:
Design and planning for the replacement of 50T mooring bollards
with 100T mooring bollards;
Design and planning of a storm water collection and treatment
system;
Planning of the infrastructure required for the future
installation of a cathodic protection system;
Design and planning for the installation of a permanent defence
where sections 95 and 94 meet;
Modifying the temporary installation plan;
Monitoring the file regarding the possibility of using a 110T
crane on the edge of the wharf wall;
Validation through calculation of the possibility of raising the
wharf deck by 750 mm in the distant future;
Providing translation, secretarial and assistance services
during the bid solicitation period and management and
coordination.
3. Any interested supplier must demonstrate by way of a
statement of capabilities that it meets the following
requirements:
Be an engineering consulting firm authorized to practise in
Quebec;
Have in its employ engineers who are members of the Ordre des
ingénieurs du Québec;
Be an engineering consulting firm with experience in marine
engineering, and more specifically in the design of plans and
specifications for commercial wharves;
Have in its employ engineers with experience in marine
engineering, and more specifically in the design of plans and
specifications for commercial wharves;
Be capable of updating existing drawings and specifications,
modifying existing designs, making additions to the original
design and delivering them signed and sealed;
Be able to deliver updated and modified drawings and
specifications within six (6) weeks of the contract award.
4. This contract is subject to the North American Free Trade
Agreement (NAFTA).
5. We believe that in accordance with the Professional
Engineering Code of Ethics, only Genivar Inc engineers can put
their seals on the updated drawings and specifications for Wharf
95. The seal of an engineer from another firm cannot be put on
the work of an unsupervised third party.
6. The following exception to the Government Contracts
Regulations is invoked for this procurement: Paragraph 6(b) -
"The estimated expenditure does not exceed $100,000, GST/HST
included."
7. The following limited tendering reason is invoked pursuant to
the North American Free Trade Agreement: Article 1016 2.(d).
8. The updated and modified drawings and specifications shall be
delivered within six (6) weeks of the contract award.
9. The estimated value of the contract, including all options,
is $74,000 (not including GST/QST).

11. Suppliers that believe that they are fully qualified and
able to provide the goods, services or construction services
described in this ACAN may submit a Statement of Capabilities in
writing to the resource person identified in this Notice on or
before the closing date of this Notice. The Statement of
Capabilities must clearly demonstrate how the supplier meets the
advertised requirements. In the event that at least one
satisfactory Statement of Capabilities is received no later than
the closing date indicated in the ACAN, PWGSC could publish a
request for proposals on MERX. In such a case, Genivar Inc would
be able to submit a bid.
12. This notice will close on April 23, 2013, at 2:00 pm.

You are hereby notified that the government intends to negotiate
with one firm only as identified above. Should you have any
questions concerning this requirement, contact the contracting
officer identified above.
An Advance Contract Award Notice (ACAN) allows departments and
agencies to post a notice, for no less than fifteen (15)
calendar days, indicating to the supplier community that it
intends to award a good, service or construction contract to a
pre-identified contractor. If no other supplier submits, on or
before the closing date, a Statement of Capabilities that meets
the requirements set out in the ACAN, the contracting authority
may then proceed with the award. However, should a Statement of
Capabilities be found to meet the requirements set out in the
ACAN, then the contracting authority will proceed to a full
tendering process.
Suppliers who consider themselves fully qualified and available
to provide the services/goods described herein, may submit a
statement of capabilities in writing to the contact person
identified in this Notice on or before the closing date of this
Notice. The statement of capabilities must clearly demonstrate
how the supplier meets the advertised requirements.
The PWGSC file number, the contracting officer's name and the
closing date of the ACAN must appear on the outside of the
envelope in block letters or, in the case of a facsimile
transmission, on the covering page.
The Crown retains the right to negotiate with suppliers on any
procurement.
Documents may be submitted in either official language of Canada.
