An advanced contract award notice (ACAN) is a public notice indicating to the supplier community that a department or agency intends to award a contract for goods, services or construction to a pre-identified supplier, thereby allowing other suppliers to signal their interest in bidding, by submitting a statement of capabilities. If no supplier submits a statement of capabilities that meet the requirements set out in the ACAN, on or before the closing date and time stated in the ACAN, the contracting officer may then proceed with the award to the pre-identified supplier.
1. Definition of requirement:
The Correctional Service Canada has a requirement for Professional Services to upgrade its ccmMercury solution to ccmEnterprise for Correspondence Control Unit (CCU) and the Claims Settlement Management System (CSMS).
1.1 Objectives:
To plan, test, convert data, implement and provide support for the upgrade of ccmMercury solution to the ccmEnterprise solution and prevent any interruption of service to the clients.

1.4 Expected results:
The successful conversion and upgrade of ccmMercury application to ccmEnterprise, with no interruption of service to the clients.
1.5 Performance standards:
All Tasks/Deliverables must be completed by January 31, 2014.
1.6 Paper consumption:
a. Should printed material be required, double sided printing in black and white format is the default unless otherwise specified by the Project Authority.
b. The Contractor must ensure printed material is on paper with a minimum recycled content of 30% and/or certified as originating from a sustainably managed forest.
c. The Contractor must recycle unneeded printed documents (in accordance with Security Requirements).
1.7 Constraints:
1.7.1 Location of work:
a. The Contractor must perform the work at CSC National Headquarters located at 170 Laurier Ave. W., Ottawa, Ontario, Canada.
b. Travel
No travel is anticipated for performance of the work under this contract.
1.7.2 Language of Work:
The contractor must perform all work in both official languages, English and French.
1.7.3 Security Requirements:
This contract includes the following security requirements:
a. The Contractor must, at all times during the performance of the Contract, hold a valid Designated Organization Screening (DOS) or a Facility Security Clearance, issued by the Canadian Industrial Security Directorate (CISD), Public Works and Government Services Canada (PWGSC).
b. The Contractor personnel requiring access to sensitive work site(s) must EACH hold a valid Reliability Status granted or approved by CISD/PWGSC.
c. Subcontracts which contain security requirements are NOT to be awarded without the prior written permission of CISD/PWGSC.
d. The Contractor must comply with the provisions of the:

2. Minimum essential requirements:
Any interested supplier must demonstrate by way of a statement of capabilities that it meets the following requirements:
The supplier must be authorized by WorkDynamics Technologies Inc. to perform the upgrade and conversion of ccmMercury to ccmEnterprise.
3. Applicability of the trade agreements to the procurement:
This procurement is subject to the following trade agreements: Agreement on Internal Trade (AIT) and North American Free Trade Agreement (NAFTA).
The procedural requirements of the other international trade agreements will be fulfilled following compliance to the procedural requirements of NAFTA and/or the WTO-AGP.
4. Set-aside under the Procurement Strategy for Aboriginal Business
This procurement is not subject to any set-asides for Aboriginal Suppliers.
5. Comprehensive Land Claims Agreement (s)
This procurement is not subject to a Comprehensive Land Claims Agreement.
6. Justification for the Pre-Identified Supplier
Correctional Service Canada is migrating to Windows 7 operating system in 2013-2014 and ccmMercury does not function on Windows 7. In order to maintain functionality and service to the clients of ccmMercury, it must be upgraded to ccmEnterprise. WorkDynamics Technologies Inc. is the sole manufacturer and sole distributor of their ccmMercury & ccmEnterprise software and related services in North America.

8. Exclusions and/or Limited Tendering Reasons
The following exclusions and/or limited tendering reasons are invoked under the section of the trade agreements specified:
North American Free Trade Agreement (NAFTA) - Article 1016: Limited Tendering Procedures, section 2.
(b) where, for works of art, or for reasons connected with the protection of patents, copyrights or other exclusive rights, or proprietary information or where there is an absence of competition for technical reasons, the goods or services can be supplied only by a particular supplier and no reasonable alternative or substitute exists.
Agreement on Internal Trade (AIT) – Article 506, 12.
a. to ensure compatibility with existing products, to recognize exclusive rights, such as exclusive licences, copyright and patent rights, or to maintain specialized products that must be maintained by the manufacturer or its representative;
9. Ownership of Intellectual Property
Ownership of any foreground intellectual property arising out of the proposed contract will vest with the Contractor.

The proposed contract is for a period of five months, from September 13th, 2013 to January 31, 2014.
11. A cost estimate of the proposed contract
The estimated value of the contract, including options, is $135,500.00(GST/HST extra).

This statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements.

The closing date and time for accepting statements of capabilities is September 10, 2013, 4:00PM EST.
