Advance Contract Award Notice
This amendment is raised to include the mandatory requirements
and change the closing date to March 14th, 2013.
Purpose of an Advance Contract Award Notice (ACAN)
An ACAN is a public notice indicating to the supplier community
that a department or agency intends to award a contract for
goods, services or construction to a pre-identified supplier,
thereby allowing other suppliers to signal their interest in
bidding, by submitting a statement of capabilities. If no
supplier submits a statement of capabilities that meets the
requirements set out in the ACAN, on or before the closing
date stated in the ACAN, the contracting officer may then
proceed with the award to the pre-identified supplier.
Definition of Requirements
The Department of Library and Archives Canada has a requirement
to:
Ensure the successful recovery of SharePoint services and all
data contained within SharePoint in the event of a failure, and
Minimize the risk of failures occurring which could result in
service interruption and/or the loss of data.
The technology currently in place at LAC does not adequately
address either of these concerns, requiring the implementation
of different technologies.
Criteria for assessment of the Statement of Capabilities
Any interested supplier must demonstrate by way of a statement
of capabilities that it meets the following requirements.
Mandatory Requirements
The technology must meet the following primary technical
requirements:
Provide full-fidelity backup and recovery, from an individual
content item to an entire SharePoint environment and all of its
farm-level components, maintaining all metadata, security
settings, and version histories.
Provide the ability to perform business context-specific data
backup and restore activities.
Provide the ability to backup from one SharePoint environment
and restore to a different one.
SQL, Remote Blob Storage aware backup and restore.
Maintain list and library integrity with full support for all
list types - including document libraries, issues lists,
discussion threads, and announcements - as well as content
metadata and configurations.
Promote or demote sites on-the-fly and copy content - from list
to list, library to library, or site to site - according to
business requirements across multiple SharePoint of SharePoint
Online environments or content databases.
Automate application lifecycle management by propagating changes
to solutions, configurations, or customizations - including
workflows - on a scheduled basis.
Plan-based deployment with customizable scheduling options allow
for consistent deployment outside of production hours,
minimizing business disruptions that can result from artifact
and customization deployment.
Other Requirements
The technology should also meet the following secondary
technical requirements:
Seamlessly move, copy, or restructure content within or across
hybrid on-premises and Cloud
Restructure the content and topology of the SharePoint
environment easily and accurately from a single, web-based
browser
Simplify content migration and restructuring tasks with
point-and-click controls
Maintain all content, configuration, security settings, and
metadata during content management tasks
Delegate solution or customization deployment tasks to
appropriate farm or solution administrators in order to increase
operational efficiency, while maintaining production environment
integrity.
Quickly identify web-front end (WFE) configurations, design
elements, and solutions that are out of sync, and propagate
changes within or across farms.
Provide the ability to perform operational tasks involving more
than one management module, without requiring custom integration
work.
Provide the ability to control (i.e.: administer, secure, and
report on) all management activities from a single console.
Copy, deploy, retract, and delete SharePoint solutions across
multiple farms from a single interface.
Copy or move Nintex Workflow 2010, SharePoint Designer 2010
workflow, and Windows Workflow definitions.
Applicability of the trade agreement(s) to the
procurement
This procurement is subject to the following trade agreement(s):
Agreement on Internal Trade (AIT), North American Free Trade
Agreement (NAFTA).
Justification for the Pre-Identified Supplier
The DocAve platform by AvePoint has been selected by LAC because
it is the only solution available on the market which satisfies
all mandatory technical requirements.
The motivation for LAC to purchase additional SharePoint
management tools is the result of a recent 'failure' in LAC's
production environment resulting in both an interruption of
service and unrecoverable data loss. The 'failure' was caused by
an unsuccessful promotion of changes from LAC's test environment
to production.
By addressing all primary technical requirements, DocAve will
ensure LAC is able to recover SharePoint without experiencing
data loss in the future.
By addressing all secondary technical requirements, DocAve is
also providing additional SharePoint management capabilities
which LAC can leverage to minimize the risk of this sort of
failure occurring again in the future.
To provide additional confirmation, the technical team at LAC
has completed an independent evaluation of DocAve and confirmed
it meets or exceeds all of the technical requirements listed
above. In particular, DocAve was able to successfully perform
the exact data recovery LAC required (and was unable to
complete) several weeks ago.
Government Contracts Regulations Exception
The following exception to the Government Contracts Regulations
is invoked for this procurement under subsection 6(d) - "only
one person or firm is capable of performing the work".
Exclusions and/or Limited Tendering Reasons
The following exclusion(s) and/or limited tendering reasons are
invoked under the section of the trade agreement(s) specified:
Agreement on Internal Trade (AIT) - Article 506, paragraph
12.(a) and 12.(b);
North American Free Trade Agreement (NAFTA) - Article 1016, 2(b)
and 2(d).
Ownership of Intellectual Property
Ownership of any Foreground Intellectual Property arising out of
the proposed contract will vest in the Contractor.
The Period of the Proposed Contract
The period of the contract will be for one year, from April 1st,
2013 to March 31st, 2014, inclusive, plus two one-year option
periods.

Suppliers who consider themselves fully qualified and available
to provide the goods, services or construction services
described in the ACAN, may submit a statement of capabilities in
writing to the contact person identified in this notice on or
before the closing date of this notice. The statement of
capabilities must clearly demonstrate how the supplier meets the
advertised requirements.

You are hereby notified that the government intends to negotiate
with one firm only as identified above. Should you have any
questions concerning this requirement, contact the contracting
officer identified above.
An Advance Contract Award Notice (ACAN) allows departments and
agencies to post a notice, for no less than fifteen (15)
calendar days, indicating to the supplier community that it
intends to award a good, service or construction contract to a
pre-identified contractor. If no other supplier submits, on or
before the closing date, a Statement of Capabilities that meets
the requirements set out in the ACAN, the contracting authority
may then proceed with the award. However, should a Statement of
Capabilities be found to meet the requirements set out in the
ACAN, then the contracting authority will proceed to a full
tendering process.
Suppliers who consider themselves fully qualified and available
to provide the services/goods described herein, may submit a
statement of capabilities in writing to the contact person
identified in this Notice on or before the closing date of this
Notice. The statement of capabilities must clearly demonstrate
how the supplier meets the advertised requirements.
The PWGSC file number, the contracting officer's name and the
closing date of the ACAN must appear on the outside of the
envelope in block letters or, in the case of a facsimile
transmission, on the covering page.
The Crown retains the right to negotiate with suppliers on any
procurement.
