An Advance Contract Award Notice (ACAN) is a public notice
indicating to the supplier community that a department or agency
intends to award a contract for goods, services or construction
to a pre-identified supplier, thereby allowing other suppliers
to signal their interest in bidding by submitting a statement of
capabilities. If no supplier submits a statement of capabilities
that meets the requirements set out in the ACAN, on or before
the closing date stated in the ACAN, the contracting officer may
then proceed with the award to the pre-identified supplier.
Public Works and Government Services Canada (PWGSC), on behalf
of the Department of National Defence Canada (DND), has a
requirement for the supply and delivery of 4 CX-5055M Riverbed
Steelheads in accordance with the attached Annex A- Technical
specifications. The contract also includes documentation and the
provision of one-year, return to depot warranty/maintenance
services. There is also an option for purchase of 4 additional
CX-5055M Riverbed Steelheads. The estimated cost of the
requirement (including the options) is $472,940.89, taxes
included. The items are to be delivered to Ottawa, Ontario.
The Department of National Defence (DND) Mercury Global project
C.0002523 has a requirement to redesign the existing Canadian
Forces (CF) Satellite Communications (SATCOM) network from a
serial based network to an internet protocol (IP) based network.
The scope of the project is to implement a new SATCOM Network
Gateway capability at each of Satellite anchor station site
using pre-existing and new hardware currently deployed by the
CF. It is imperative that the requested equipment be
interoperable with currently owned and functioning equipment to
ensure system compatibility.
The CX-5055M Steelheads from Riverbed Technology requested are
the sole equipment that can ensure a seamless integration with
existing satellite communications hardware, and are compatible
with the hardware acquired by the ADM (IM) DIMEI group under the
Shared Services Canada (SSC) Network Equipment Standing Offer
(NESS SO) EN869-060297/002/EO. Because the SCPS protocol for
satellite optimization is critical for the solution to function,
and the compatibility of the design must be interoperable with
existing hardware, this hardware must be proprietary to Riverbed
Technology, the Original Equipment Manufacturer (OEM).
The requirement is subject to the provisions of the World Trade
Organisation Agreement on Government Procurement (WTO-AGP), the
North American Free Trade Agreement (NAFTA), the Canada-Chile
Free Trade Agreement (CCFTA) and the Agreement on Internal Trade
(AIT).
Suppliers who consider themselves fully qualified and available
to provide the services/goods described herein may submit a
statement of capabilities in writing to the contracting
authority identified in this notice on or before the closing
date of this notice. The statement of capabilities must clearly
demonstrate how the supplier meets the advertised requirements.

An Advance Contract Award Notice (ACAN) allows departments and
agencies to post a notice, for no less than fifteen (15)
calendar days, indicating to the supplier community that it
intends to award a good, service or construction contract to a
pre-identified contractor. If no other supplier submits, on or
before the closing date, a Statement of Capabilities that meets
the requirements set out in the ACAN, the contracting authority
may then proceed with the award. However, should a Statement of
Capabilities be found to meet the requirements set out in the
ACAN, then the contracting authority will proceed to a full
tendering process.
Suppliers who consider themselves fully qualified and available
to provide the services/goods described herein, may submit a
statement of capabilities in writing to the contact person
identified in this Notice on or before the closing date of this
Notice. The statement of capabilities must clearly demonstrate
how the supplier meets the advertised requirements.
The PWGSC file number, the contracting officer's name and the
closing date of the ACAN must appear on the outside of the
envelope in block letters or, in the case of a facsimile
transmission, on the covering page.
The Crown retains the right to negotiate with suppliers on any
procurement.
