1. Advance Contract Award Notice (ACAN)
An ACAN is a public notice indicating to the supplier community
that a department or agency intends to award a contract for
goods, services or construction to a pre-identified supplier,
thereby allowing other suppliers to signal their interest in
bidding, by submitting a statement of capabilities. If no
supplier submits a statement of capabilities that meets the
requirements set out in the ACAN, on or before the closing date
stated in the ACAN, the contracting officer may then proceed
with the award to the pre-identified supplier.
2. Definition of Requirements
The Department of National Defence (DND), 435 Squadron requires
the supply and delivery of one (1) new TecScan (or equivalent)
Two Axis Semi-Automated Ultrasonic Testing Immersion Tank.
Delivery is to DND Winnipeg, Manitoba on or before March 31,
2015.
3. Any interested supplier must demonstrate by way of a
statement of capabilities that its
equipment meets the following requirements.
a. The unit must be fully compatible with existing TecScan NDT
inspection equipment
and software.
b. The unit must be a Sealed and Clear Acrylic Tank with
dimensions 36"W x 24"H x 18"D.
c. The unit must have Aluminum Profile Support Structure
d. The unit must have wheeled/casters for ease of mobility when
filled with water
e. The unit must have ball screw driven actuator with servo
motor for X and Y axis
f. The unit must be manual position capability with course and
fine adjustments for Z axis.
g. The unit must have stainless steel UHF search tube.
h. The unit must be equipped with all required mechanical
stoppers.
i. The unit must have electronic enclosure mounted on tank
support structure.
j. The unit must have electronic servo motor with push button
switches for manipulation of
X and Y axis.
k. The unit must have independent velocity controls.
l. The unit must have end of travel limit switches.
m. The unit must have physical measurement indicators for all
three (3) stages.
n. The unit must have system operations and maintenance manuals.
o. The unit must have a one (1) year warranty against
manufacturing defects.
p. The unit must have on line and on call technical support for
hardware and software.

5. Justification for the Pre-Identified Supplier
Currently, Aerospace and Telecommunications Engineering Support
Squadron (ATESS) Trenton has the TecScan Immersion tank that is
used by all Non-Destructive Testing (NDT) Technicians when they
go to Trenton for their NDT 1 course and then again when they
return to do their Canadian General Standards Board (CGSB)
practical exam. This purchase is to have all units with the
same one to create universality between units so that
technicians are familiar with the immersion tank prior to
attempting the CGSB exam.

The following exception(s) to the Government Contracts
Regulations is (are) invoked for this procurement:
Agreement on Internal Trade (AIT) -: Government Contract
Regulations, Part 1, Section 6(d) only one supplier (person or
firm) is capable of performing the contract.
7. Exclusions and/or Limited Tendering Reasons
The following exclusion(s) and/or limited tendering reasons are
invoked under the:
Agreement on Internal Trade (AIT) - Article 506-12 (b); Where
there is an absence of competition for technical reasons and the
goods or services can be supplied only by a particular supplier
and no alternative or substitute exists.
North American Free Trade Agreement (NAFTA) - Article 1016:
Limited Tendering Procedures;
(b) where, for works of art, or for reasons connected with the
protection of patents, copyrights or other exclusive rights, or
proprietary information or where there is an absence of
competition for technical reasons, the goods or services can be
supplied only by a particular supplier and no reasonable
alternative or substitute exists;
8. The equipment and deliverables must be delivered on or before
March 31, 2015.
9. The estimated value of the contract, is $35,000.00 (GST/HST
included).

11. Suppliers' Right to Submit a Statement of Capabilities
Suppliers who consider themselves fully qualified and available
to provide the goods, services or construction services
described in the ACAN may submit a statement of capabilities in
writing to the contact person identified in this notice on or
before the closing date of this notice. The statement of
capabilities must clearly demonstrate how the supplier meets the
advertised requirements.
The closing date and time for accepting statements of
capabilities is:
October 2, 2014 at 2:00 PM Central Standard Time (CST)

You are hereby notified that the government intends to negotiate
with one firm only as identified above. Should you have any
questions concerning this requirement, contact the contracting
officer identified above.
An Advance Contract Award Notice (ACAN) allows departments and
agencies to post a notice, for no less than fifteen (15)
calendar days, indicating to the supplier community that it
intends to award a good, service or construction contract to a
pre-identified contractor. If no other supplier submits, on or
before the closing date, a Statement of Capabilities that meets
the requirements set out in the ACAN, the contracting authority
may then proceed with the award. However, should a Statement of
Capabilities be found to meet the requirements set out in the
ACAN, then the contracting authority will proceed to a full
tendering process.
Suppliers who consider themselves fully qualified and available
to provide the services/goods described herein, may submit a
statement of capabilities in writing to the contact person
identified in this Notice on or before the closing date of this
Notice. The statement of capabilities must clearly demonstrate
how the supplier meets the advertised requirements.
The PWGSC file number, the contracting officer's name and the
closing date of the ACAN must appear on the outside of the
envelope in block letters or, in the case of a facsimile
transmission, on the covering page.
The Crown retains the right to negotiate with suppliers on any
procurement.
