TITLE: Auto Analyzer AA3 HR
Advance Contract Award Notice (ACAN)
An ACAN is a public notice indicating to the supplier community that a department or agency intends to award a contract for goods, services or construction to a pre-identified supplier, thereby allowing other suppliers to signal their interest in bidding, by submitting a statement of capabilities. If no supplier submits a statement of capabilities that meets the requirements set out in the ACAN, on or before the closing date stated in the ACAN, the contracting officer may then proceed with the award to the pre-identified supplier.
1. Definition of the requirement
The Department of Environment and Climate Change Canada’s Pacific and Yukon Laboratory for Environmental Testing (PYLET) has a requirement for a nutrient analyzer for measurement of extremely low concentrations of Phosphorus and Ortho-Phosphorus in seawater and freshwater.
2. Criteria for assessment of the Statement of Capabilities
Any interested supplier must demonstrate by way of a statement of capabilities that its equipment meets the following requirements:
The Auto Analyzer System must have the following:
1. The analyzer must measure concentrations of the following nutrients: phosphate (PO4), and ortho phosphate.
2. The instrument must feature a channel for each type of analysis (2 channel analyzer)
3. The analyzer must feature detection limits as listed for both analytes (in umol/l) for very low nutrient seawater analysis purposes without matrix effects.
4. The instrument must be able to detect the following concentration ranges:
Usual nutrient concentrations found in our samples (umol/l)
Nutrient Range MDL
Phosphate
Ortho Phosphate
in various water matrices 0.0 to 1.6
0 to 16 0.009
0.009
5. The analyzer must be capable of processing throughput speeds of minimum 60 tests per hour per channel (120 total/hour)
6. The chemistries must be designed and proven for freshwater and seawater matrices, and follow recognized methods for seawater and freshwater used worldwide.
7. The analyzer must analyze nutrient concentrations according to the Macro Continuous Segmented Flow method of analysis (designed for a large number of samples, a limited number of parameters and high reproducibility).
8. The analyzer must use 2 mm flow tubing to reduce maintenance and facilitate ease of use for the operator.
9. The analyzer must have LED light sources to reduce baseline noise and provide long life.
10. The analyser must use ?bubble-through? technology in the flow cell, in order to prevent trapping of particles or bubbles. This is a requirement for preventing sample reruns and un-necessary maintenance.
11. The analyzer must use a separate reference beam on each light source to reduce drift and precision errors.
3. This procurement is subject to the following trade agreement(s)
Canadian Free Trade Agreement (CFTA)
North American Free Trade Agreement (NAFTA)
4. Justification for the Pre-Identified Supplier
PYLET requires the AA3 HR Auto Analyzer as it is a nutrient anaylzer for measurement of extremely low concentrations of Phosporous and Ortho-Phosphorus in seawater and freshwater.
The AA3 HR Auto Analyzer has the Macro Continuous Segmented Flow method of analysis, designed for a large number of samples with limited number of parameters and high reproducibility which is a technology unique to this analyzer, manufactured only by Seal Analytical, and whose only sole distributer in Canada is Folio Instruments Inc.
Besides the macro segmented flow technology, it also has the capability of processing throughput speeds of Minimum 60 tests per hour per channel (120 total/hour), and uses the ?bubble-through? technology in the flow cell in order to prevent trapping of particles or bubbles. This is a requirement for preventing sample reruns and un-necessary maintenance.
Pacific and Yukon Laboratory for Environmental Testing (PYLET) already has the older version of this instruments in use in their lab and it is critical to procure the same equipment due to commonality, ensuring use of the same software, will produce accurate data, ease of use and throughput. With this system, there will be lab supplies and instrument parts interchangeability.
5. Government Contracts Regulations Exception
The following exception to the Government Contracts Regulations is invoked for this procurement under subsection 6(d) - "only one person is capable of performing the work".
6. Limited Tendering Reasons
The following limited tendering reasons are invoked under the (section of the trade agreement(s) specified):
Canadian Free Trade Agreement (CFTA) - Article 513 Item 3b. Where the goods or services can be supplied only by a particular supplier and nor reasonable alternative or substitute goods or services exist.
North American Free Trade Agreement (NAFTA) - Article 1016 Item 2b. Where for works of art, or for reasons connected with the protection of patents, copyrights or other exclusive rights, or proprietary information or where there is an absence of competition for technical reasons and the goods or services can be supplied only by a particular supplier and no reasonable alternative or substitute exists.
7. Period of the proposed contract or delivery date
The equipment must be delivered on or before March 29, 2019.
8. Cost estimate of the proposed contract
The estimated value of the contract is CDN $54,520.20 (Incl. applicable taxes, shipping and handling).
9. Name and address of the pre-identified supplier
Folio Instruments Inc.

10. Suppliers' right to submit a statement of capabilities
Suppliers who consider themselves fully qualified and available to provide the goods, services or construction services described in the ACAN may submit a statement of capabilities in writing to the contact person identified in this notice on or before the closing date of this notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements.
Suppliers must include in the statement of capability submission 3 examples of similar instruments installed in Canada.
11. Closing date for a submission of a statement of capabilities
The closing date and time for accepting statements of capabilities is on or before December 14, 2018 2:00 P.M. PST.
