A directed contract is currently in place for a workshop entitled "Writing Compelling Commentary: Knowledge Mobilization through Strategic Media Relations Workshop series"
The current contract value is $ 20,905.00 including all applicable taxes.
An Amendment is proposed in the amount of $10,140.65 increasing the total contract value to $31,056.65.
The amendment is requested for the purpose of adding additional training sessions to the series.
The Supplier has registered ownership of the Intellectual Property Rights to the specifed course and program.
1. Advance Contract Award Notice (ACAN)
An ACAN is a public notice indicating to the supplier community that a department or agency intends to award a contract for goods, services or construction to a pre-identified supplier, thereby allowing other suppliers to signal their interest in bidding, by submitting a statement of capabilities. If no supplier submits a statement of capabilities that meets the requirements set out in the ACAN, on or before the closing date stated in the ACAN, the contracting officer may then proceed with the award to the pre-identified supplier.
2. Definition of the requirement
The Department of the Natural Sciences and Engineering Research Council of Canada has a requirement to provide training and a series of workshops on Writing Compelling Commentary: Knowledge Mobilization Through Strategic Media Relations Workshops.
The work will involve running five workshops, in six locations across Canada for female researchers.
The Contractor must:
1. Deliver five workshops across Canada in cities agreed to by the contractor and NSERC in NSERC’s five regions (Atlantic, Ontario, Prairies, Pacific, and Quebec).
2. The workshops must demonstrate a high level of client satisfaction, as demonstrated by exit surveys/evaluations.
3. Be able to deliver a workshop in French targeted for the Quebec media market (TBC based on participant interest and enrollment).
4. Fully facilitate, teach and lead each workshop, using a developed agenda that is agreed to between NSERC and the contractor. Workshops must:
a. Review the essential elements and format of newspaper commentaries (engaging participants in exercises to identify, craft and get feedback on news hooks relevant to their disciplines and research, and means of engaging audiences not already familiar with the issues being addressed);
b. Provide follow-up one-on-one editing feedback on draft op-eds written within a six-month period individually to each participant at no additional cost to participants or to NSERC.
c.Provide participants with the confidence and tools to contribute their expertise to the public discourse through written commentary and media interviews.

Only one person is capable of performing the contract GCRs 6.(d)).
The exception should only be invoked where patents, copyright requirements, or technical compatibility factors and technological expertise suggest that only one contractor exists.

The following exception(s) to the Government Contracts Regulations is (are) invoked for this procurement under subsection 6(d) - "only one person is capable of performing the work").

The following exclusion(s) and/or limited tendering reasons are invoked under the section 6.d of the GCR’s.
Whereas, the proposed suppliers owns the intellectual Property Rights to the training and course content and material.
10. Ownership of Intellectual Property
Ownership of any Foreground Intellectual Property arising out of the proposed contract will vest in the Contractor.
