1. Advance Contract Award Notice
An Advance Contract Award Notice (ACAN) is a public notice indicating to the supplier community that a department or agency intends to award a contract for goods, services or construction to a pre-identified supplier, thereby allowing other suppliers to signal their interest in bidding, by submitting a statement of capabilities. If no supplier submits a statement of capabilities that meets the requirements set out in the ACAN, on or before the closing date stated in the ACAN, the contracting officer may then proceed with the award to the pre-identified supplier.
2. Definition of the Requirement
Parks Canada has a requirement for the supply and delivery of a commercial off-the shelf (COTS), 17-foot aluminum boat with surface drive engine and accompanying trailer. The boat will be used for law enforcement and emergency response operations and will be shore-based, depending on Parks Canada's operational requirements.
3. Minimum Essential Requirements
Any interested supplier must demonstrate by way of a statement of capabilities that its product:
(a) Is equivalent to the GTB1754 Gator-Tail Boat (Enforcement Series) with 993ccc Big Block CDI 37HP Vanguard Marine Engine;
(b) Includes a suitable accompanying trailer;
(c) Can perform Parks Canada's law enforcement and emergency response operations in shallow lakes with extremely muddy water without any modifications; and
(d) Can be delivered on or before March 31, 2020.
4. Applicability of the Trade Agreements
This procurement is subject to the following trade agreements:
- Canadian Free Trade Agreement (CFTA)

5. Justification for the Pre-Identified Supplier
The pre-identified supplier offers a product that meets Parks Canada's requirements. Parks Canada has the same product performing the same duties at another Parks Canada location and can be interchanged with this product. To the knowledge of Parks Canada, the pre-identified supplier is the only company able to provide the required goods.
6. Government Contracts Regulations Exception
The following exception to the Government Contracts Regulations is invoked for this procurement under subsection 6(d): Only one person or firm is capable of performing the work.
7. Exclusions and/or Limited Tendering Reasons
