Purpose of an Advance Contract Notice (ACAN)
An Advance Contract Award Notice (ACAN) allows department and
agencies to post a notice, for no less than fifteen (15)
calendar days, indicating to the supplier community that it
intends to award a goods, service or construction contract to a
pre-identified supplier. If no other supplier submits, on or
before the closing date, a Statement of Capabilities that meets
the requirements set out in the ACAN, the contracting authority
may then proceed with the award. However, should a Statement of
Capabilities be found to meet the requirements set out in the
ACAN, then the contracting officer will proceed to a full
tendering process.
2. Definition of requirements and sole source justification
Public Health Agency of Canada, the National Laboratory for HIV
Reference Services (NLHRS), Winnipeg, Manitoba has a requirement
for the supply, delivery and offloading of one (1) BioTek
Synergy H4 Hybrid Multi-Mode Microplate Reader to augment
already existing equipment in place.
The Reader must:
use the same analysis software as Biotek Synergy H2M Plate
Reader;
be a Hybrid Multimode reader with quadruple monochromators as
well as filters / dichroic mirrors to maximize assay flexibility
and sensitivity;
reading modes must include: UV/Vis Absorbance, Fluorescence
Intensity, Time-Resolved Fluorescence, Fluorescence
Polarization, Luminescence, and AlphaScreen;
detection modes must include: End-point, kinetic, spectral
scanning, well-area scanning;
be compatible with a variety of microplate types: Specifically,
the monochromator system 1- to 384-well plates; Filter system 1-
to 1536-well plates; PCR plates; Also, compatible with and
include low volume plate with 16 (or 48) x 2 ?L microspots for
DNA/RNA/Protein quantification;
temperature Control requirements: 4º C above ambient to at least
65ºC (± 0.5ºC at 37ºC);
Onboard Reagent Dispensers required: At least 2 syringe pumps;
Delivery must be no later than March 31, 2014.

particular supplier and no alternative or substitute exists;"
4. Government Contracts Regulations Exception
This contract is subject to subsection 6 (d) of the Government
Contracts Regulations, in that only one person or company is
capable of performing the contract.

8. Submission of Statement of Capabilities by Suppliers
Suppliers who consider themselves fully qualified and available
to provide the services/goods described herein, may submit a
statement of capabilities in writing to the contact person
identified in this Notice on or before the closing date of this
Notice. The statement of capabilities must clearly demonstrate
how the supplier meets the advertised requirements.
The PWGSC file number, the contracting officer's name and the
closing date of the ACAN must appear on the outside of the
envelope in block letters or, in the case of a facsimile
transmission, on the covering page.
The Crown retains the right to negotiate with suppliers on any
procurement.
Documents may be submitted in either official language of Canada.
