Advance Contract Award Notice (ACAN) for
GreenLine Systems Canada to conduct the customization of the MDA
Enterprise tool
Requirement:
The Department of National Defence (DND) has a requirement for
the provision of services as described in this Advance Contract
Award Notice (ACAN) (referred hereto as the Services). The
purpose of this ACAN is to signal the government's intention to
award a contract for the Services to GreenLine Systems Canada.
However, before awarding a contract, the Government would like
to provide suppliers with the opportunity to review the
Services. In order to be considered you must demonstrate your
compliance with the Services and submit a statement of
capabilities during the 15 calendar day posting period.
If other potential suppliers submit a statement of capabilities
during the 15 calendar day posting period and can demonstrate
they comply and can meet all of the Services, the government
will proceed with a full tendering process.
If no supplier(s) submits, on or before the closing date, a
statement of capabilities for the Services, a contract will be
awarded to the pre-selected supplier.
Background:
The Marine Security Operations Centre (MSOC) Project is an
interdepartmental project, whose core partners are the Canada
Border Services Agency (CBSA), Department of Fisheries and
Oceans (DFO) / Canadian Coast Guard (CCG), Royal Canadian
Mounted Police (RCMP), Transport Canada (TC) and the Canadian
Armed Forces (CAF)/Department of National Defence (DND). DND
has been designated the lead department for project
implementation. The resulting MSOCs will have the capacity in
terms of personnel, technology and physical infrastructure
resources that will allow them to detect, assess and support
response to a direct or indirect marine security threat.
Securing an open society, Canada's National Security Policy
2004, introduced the need for the MSOCs to meet both marine and
national security challenges of the 21st century. The function
of the MSOCs is to enable departments and agencies to work
collaboratively to collect and analyze intelligence and other
information in an effort to develop solid awareness in their
area of responsibility with regard to marine security, and to
support a national response to perceived and real marine
security threat to the country.
In support of this key function, DND recently procured the
GreenLine Systems Canada's Maritime Domain Awareness (MDA)
Enterprise tool as a solution that displays real-time and
historical vessel data, in addition to other reference and
operational data layers from the five core departments, and
allows for the identification, assessment and reporting of
maritime activities that represent a potential threat to the
sovereignty, security and safety of Canada. This was
effectively an upgrade from the MDA WatchKeeper tool that is
currently used by several of the MSOC partners. The transition
from MDA WatchKeeper to MDA Enterprise allows all of the
resultant data to be held securely behind Canadian firewalls.
Under normal circumstances, MDA Enterprise would be purchased as
a stand-alone Commercial Off-The-Shelf (COTS) tool. However,
the MSOC Project is integrating MDA Enterprise, along with a
number of other COTS products, into an MSOC Information Portal
that is being hosted on two custom-built Information Technology
(IT) infrastructures provided by Shared Services Canada (SSC)
and DND respectively. As a result, the MDA Enterprise tool
must be customized to allow it to work within this
infrastructure, to accept additional data feeds from some of the
MSOC partners, and to seamlessly integrate with other MSOC sub
systems and products including Geo-Spatial Information Systems,
Maritime Interest Management systems, and the MSOC Information
Portal.
As such, DND intends to contract with GreenLine Systems Canada
to conduct the customization of the MDA Enterprise tool
described above. Public Works and Government Services Canada
(PWGSC), on behalf of its Client, DND, intends to enter into a
sole source contract with GreenLine Systems Canada for the
purpose of integrating the GreenLine Systems Canada MDA
Enterprise tool within the information technology
infrastructures that have been provided to the MSOC Project by
Shared Services Canada (SSC) and DND, as well as configuring and
integrating MDA Enterprise with other MSOC sub systems and
products including Geo-Spatial Information Systems, Maritime
Interest Management systems, the MSOC Information Portal, and
various sources of position and tombstone data for International
Maritime Organization (IMO) registered vessels. The contract
will also include the provision of subject matter expertise and
training on the use, support and maintenance of the MDA
Enterprise application, as well as a series of "as and when
needed" professional services options, in order to maintain and
support the use of the MDA Enterprise tool and to make any
required modifications.
Minimum Essential Requirements:
Any interested supplier must demonstrate by way of a statement
of capabilities that it meets all of the mandatory requirements
at Annex A.
Justification For The Pre-selected Supplier
The reasons for single tendering are as follows:
In order to complete the customization work to the MDA
Enterprise tool described above, a service provider must have
in-depth knowledge of the MDA Enterprise tool and must have the
authority to access GreenLine Systems Canada's Intellectual
Property, including source code and detailed design information.
It is our understanding that GreenLine has not and will not
provide its Intellectual Property to any third party. As a
result, the services required by the MSOC Project to customize
and integrate MDA Enterprise into the overarching MSOC
Information Portal can only be provided by GreenLine Systems
Canada
As such, Section 6 of the Government Contract Regulations is
being invoked in this procurement as only one person or firm is
capable of performing the contract.
Articles 506.12(a) and 506.12(b) of AIT are applicable on the
basis of limited tendering due to compatibility with existing
products, to recognize exclusive rights, such as exclusive
licenses, copyright and patent rights, or to maintain
specialized products that must be maintained by the manufacturer
or its representative, and when there is an absence of
competition for technical reasons and the goods or services can
be supplied only by a particular supplier and no alternative or
substitute exists, respectively.
Articles 1016.2(b) and 1016.2(d) of NAFTA are applicable on the
basis of limited tendering due to reasons where, for works of
art, or for reasons connected with the protection of patents,
copyrights or other exclusive rights, or proprietary information
or where there is an absence of competition for technical
reasons, the goods or services can be supplied only by a
particular supplier and no reasonable alternative or substitute
exists, for additional deliveries by the original supplier that
are intended either as replacement parts or continuing services
for existing supplies, services or installations, or as the
extension of existing supplies, services or installations, where
a change of supplier would compel the entity to procure
equipment or services not meeting requirements of inter
changeability with already existing equipment or services,
including software to the extent that the initial procurement of
the software was covered by this Chapter, respectively.
Period OF Contract
The expected timeframe for the primary component of the proposed
contract with GreenLine Systems Canada, which is to customize
the MSOC Project's existing copy of the MDA Enterprise tool and
to provide related professional services, is from 3 Sep 2013 to
31 Mar 2014.
In addition, the proposed contract will include the provision of
on-going maintenance and support of the MDA Enterprise tool via
a number of Contract Options that can be exercised by the MSOC
Project Capability Management Organization (CMO) after the
closure of the MSOC Project. The proposed timeframes of these
options are as follows:
Option 1 - 1 April 2014 to 31 March 2015;
Option 2 - 1 April 2015 to 31 March 2016;
Option 3 - 1 April 2016 to 31 March 2017;
Option 4 - 1 April 2017 to 31 March 2018; and
Option 5 - 1 April 2018 to 31 March 2019.
Closing Date And Time For Written Supplier Responses Challenging
This Requirement Is 2:00 p.m. EST, 21 August 2013.

bid and negotiate with one firm only as identified above.
If you wish to submit a written response showing that you are
capable of meeting this requirement, it must be done not later
than the specified closing date and time. The file number,
contracting officer's name, and the closing date of the ACAN
must appear on the outside of the envelope in block letters or,
in the case of a facsimile transmission, on the covering page.
As it is intended to proceed in a timely manner, responses
received after the closing date will not be considered.
Responses received on or before the closing date will be
considered solely for the purpose of deciding whether or not to
conduct a competitive procurement. Information provided will be
used by the Crown for technical evaluation purposes only and is
not to be construed as a competitive solicitation. Your written
response must provide sufficient evidence (e.g. specifications,
technical data, drawings, or any other proof) that clearly
demonstrates that your product or service is capable of
fulfilling this requirement. Suppliers that have submitted a
response will be notified in writing of PWGSC's decision to
continue with the non-competitive procurement or to compete the
requirement.

ANNEX A
The contractor must provide the following services:
a. Plan, install, configure and integrate MDA Enterprise within
the MSOC-specific Protected B IT infrastructure being provided
by Shared Services Canada;
b. Plan, install, configure and integrate MDA Enterprise within
the MSOC-specific Classified IT infrastructure being provided by
DND;
c. Modify MDA Enterprise to ingest GPW data to ensure that the
vessel positions displayed are the most recent possible and
consistent with those reported within DND;
d. Modify MDA Enterprise to ingest e-PAIRS data provided by TC;
e. Modify MDA Enterprise to ingest other GOC data sources as
specified by the MSOC Project Office;
f. Modify MDA Enterprise to ingest and display GIS mapping
layers provided by the MSOC project's ESRI ArcGIS geo-data
servers;
g. Modify and integrate MDA Enterprise with the MSOC Project's
Microsoft SharePoint -based Information Portal to allow single
sign-on from the Portal and to have Enterprise inherit the
strict access control constraints that the Portal employs;
h. Modify and integrate MDA Enterprise with the MSOC Project's
Microsoft Fusion-based Maritime Interest Management-Maritime
Analysis Console to allow Maritime Interest Requests, Maritime
Interest Requirement information, tasks, alerts and User
Identifications to be exchanged;
i. Modify and integrate MDA Enterprise with the MSOC Project's
Microsoft Investigator-based Maritime Interest
Management-Maritime Investigative Console to allow Maritime
Interest Requests, Maritime Interest Requirement information,
tasks, alerts and User Identifications to be exchanged;
j. Modify and integrate MDA Enterprise with the MSOC Project's
Microsoft Insight-based Maritime Interest Management reporting
tool to allow Maritime Interest Requests, Maritime Interest
Requirement information, tasks, and alerts to be distributed to
MSOC Partners in various formats as required;
k. Develop and deliver a training package that, as a minimum,
covers general use of the MDA Enterprise application, specific
risk model generation for advanced users, and maintenance and
system administration guidance for support personnel; and
l. Provide on-going maintenance, upgrades, subject matter
expertise and support to the MDA Enterprise application within
the MSOC Portal beyond the life of the MSOC Project.

An Advance Contract Award Notice (ACAN) allows departments and
agencies to post a notice, for no less than fifteen (15)
calendar days, indicating to the supplier community that it
intends to award a good, service or construction contract to a
pre-identified contractor. If no other supplier submits, on or
before the closing date, a Statement of Capabilities that meets
the requirements set out in the ACAN, the contracting authority
may then proceed with the award. However, should a Statement of
Capabilities be found to meet the requirements set out in the
ACAN, then the contracting authority will proceed to a full
tendering process.
Suppliers who consider themselves fully qualified and available
to provide the services/goods described herein, may submit a
statement of capabilities in writing to the contact person
identified in this Notice on or before the closing date of this
Notice. The statement of capabilities must clearly demonstrate
how the supplier meets the advertised requirements.
The PWGSC file number, the contracting officer's name and the
closing date of the ACAN must appear on the outside of the
envelope in block letters or, in the case of a facsimile
transmission, on the covering page.
The Crown retains the right to negotiate with suppliers on any
procurement.
