1. Advance Contract Award Notice (ACAN)

An ACAN is a public notice indicating to the supplier community that a department or agency intends to award a contract for goods, services or construction to a pre-identified supplier, thereby allowing other suppliers to signal their interest in bidding, by submitting a statement of capabilities. If no supplier submits a statement of capabilities that meets the requirements set out in the ACAN, on or before the closing date stated in the ACAN, the contracting officer may then proceed with the award to the pre-identified supplier.

2. Definition of the requirement

The Department of Agriculture and Agri-Food Canada has a requirement for the supply of one (1) Biolistic® PDS-1000/He System with Hepta? Adaptor, 500 Optimization Kit, and service plan.

Biolistic® PDS-1000/He

The PDS-1000/He system accelerates nucleic acid-coated gold or tungsten microparticles (0.6-1.6 µm) to velocities necessary to transfect cells, tissues, or organelles. The system uses a burst of high-pressure helium gas to accelerate a plastic macrocarrier disk carrying microparticles toward target cells.

The helium pressure used to propel the macrocarrier is determined by the choice of rupture disk, a plastic seal designed to burst at a specific pressure. A stopping screen retains the macrocarrier while allowing the microparticles to pass through and penetrate the target cells. To increase the efficiency of the process, the chamber may be evacuated to subatmospheric pressures, reducing the frictional drag on the microparticles as they travel toward the target cells.

Key Features

  • A reproducible method for transforming intact cells in culture, requiring little manipulation of cells
  • Transformation of cells with unique growth requirements that are not amenable to other methods of transfection
  • Maximum control
  • High reproducibility

PDS-1000/He System with Hepta? Adaptor

The Hepta adaptor for the PDS-1000/He biolistic system enables 7-10 times more cells to be transformed than the standard system. It fits into the shocking chamber of the PDS-1000/He system where it splits the helium shock wave over seven macrocarriers. By uniformly spreading the DNA-coated gold or tungsten particles over this larger area, the system maximizes the number of cells transformed during one bombardment. As the helium is split seven ways, pressure and particle velocities are reduced, making the system ideal for plants and cell cultures requiring less forceful penetration.

500 Optimization Kit

The optimization kit comes with the PDS-1000/He System and includes 0.25 g each of 0.6 µm, 1.0 µm and 1.6 µm gold microcarriers, 100 each of 9 rupture disks, for 500 bombardments. This is a starter kit and used in conducting biolistic transformation.

3. Criteria for assessment of the Statement of Capabilities (Minimum Essential Requirements)

Any interested supplier must demonstrate by way of a statement of capabilities that its system meets the following requirements:

a. The instrument must be capable of performing biolistic transformation
b. The instrument must employ a method for launching the biologically coated microcarriers from the target side of a planar surface of a flexible plastic sheet that is positioned to be accelerated by the gas shock wave such that it will move freely in the direction of the target cells until restrained by a barrier
c. The instrument must contain a throat region in the high pressure gas delivery system
d. The instrument must use interchangeable rupture disks available in 450, 650, 900, 1,100, 1,350, 1,550, 1,800, 2,000 and 2,200 pounds per square inch (psi) pressure
e. The instrument must be capable of generating high pressure gas delivery with a mechanism for delivering an instantaneous cold gas shock wave into an enclosure where the gas shock is released, contained and vented
f. The equipment must be CSA approved upon delivery to Agriculture & Agri-Food Canada.

4. Applicability of the trade agreement(s) to the procurement:

  • Canadian Free Trade Agreement (CFTA) OR Agreement on Internal Trade (AIT)
  • North American Free Trade Agreement (NAFTA)

5. Justification for the Pre-Identified Supplier

a. The system is covered by patents numbers 161807, 670771, 877619, 074652, IP-0844, 07/303/503, 07/529989, 437848, 4945050, 5036006, 5100792, and 621561 together with all continuations, divisionals, and continuations-in-part applications, any patents that issue on applications and reissues thereof. The Biolistic PDS-1000/He instrument is available for sale or lease accordingly. Biolistic is a registered trademark of E. I. du Pont de Nemours and Company. The Biolistic technology is exclusively licensed to Bio-Rad laboratories.

b. A system capable of generating high pressure gas delivery with a mechanism for delivering an instantaneous cold gas shock wave into an enclosure where the gas shock is released, contained and vented.

c. The unit contains a throat region in the high pressure gas delivery system that allows for interchangeable inserts (rupture disks) which translates the cold gas shock into acceleration of microprojectiles coated with biological molecules for delivery into diverse target cells/tissue without killing the cells and/or tissue. Nine interchangeable disks are available in 450, 650, 900, 1,100, 1,350, 1,550, 1,800, 2,000 and 2,200 pounds per square inch (psi) pressure.

d. Employs a method for launching the biologically coated microcarriers from the target side of a planar surface of a flexible plastic sheet that is positioned to be accelerated by the gas shock wave such that it will move freely in the direction of the target cells until restrained by a barrier. The barrier permits the microcarriers to move toward the target cells and also effectively baffles the gas shock wave to deflect some of the force of the cold gas shock wave away from the target cells with sufficient acceleration of microprojectiles coated with biological molecules for delivery into diverse target cells/tissue without killing the cells and/or tissue.

6. Government Contracts Regulations Exception(s)

The following exception(s) to the Government Contracts Regulations is (are) invoked for this procurement under subsection 6(d) - "only one person is capable of performing the work".

7. Exclusions and/or Limited Tendering Reasons

The following exclusion(s) and/or limited tendering reasons are invoked under the:

  • Canadian Free Trade Agreement (CFTA) - Articles 513.1(b) (iii) due to an absence of competition for technical reason.
  • North American Free Trade Agreement (NAFTA) - Article 1016.2(b) where, for works of art, or for reasons connected with the protection of patents, copyrights or other exclusive rights, or proprietary information or where there is an absence of competition for technical reasons, the goods or services can be supplied only by a particular supplier and no reasonable alternative or substitute exists;

8. Delivery date

The system must be delivered on or before March 15, 2018.

9. Cost estimate of the proposed contract

The estimated value of the contract is $ 40,454.40 (GST/HST extra).
