Nature of Requirements:
1. Purpose of an Advance Contract Notice (ACAN)
An Advance Contract Award Notice (ACAN) allows department and
agencies to post a notice, for no less than fifteen (15)
calendar days, indicating to the supplier community that it
intends to award a goods, service or construction contract to a
pre-identified supplier. If no other supplier submits, on or
before the closing date, a Statement of Capabilities that meets
the requirements set out in the ACAN, the contracting authority
may then proceed with the award. However, should a Statement of
Capabilities be found to meet the requirements set out in the
ACAN, then the contracting officer will proceed to a full
tendering process.
2. Definition of requirements and sole source justification
Regional Individual Standing Offer for the supply, delivery and
off-loading of milk, dairy products, bakery products, fresh and
frozen meat, seafood and poultry, fresh and frozen produce,
beverages, and miscellaneous grocery items to the Department of
National Defence, Special Task Forces, FOL Site Inuvik, Inuvik,
N.W.T. on an "as required" basis for a three year period
commencing January 1, 2014 to December 31, 2016 inclusive.
The FOL Inuivik operations is an isolated location in the
Northwest Territories. The Stanton Group Ltd. is the only known
grocery supplier capable of supplying the FOL site with these
food requirements in the critical time required and capable of
meeting the demands in an accurate and timely manner for the
volumes necessary for rapid deployment of Department of National
Defence personnel to the North.
3. Trade Agreements
This proposed procurement is subject to the following
Comprehensive Land Claim Agreements (CLCAs);
(a) The Inuvialuit Final Agreement;
(b) The Gwich'in Comprehensive Land Claim Agreement
Article 506, Section 12 (b) of the Agreement on Internal Trade
(AIT)
"...where there is an absence of competition for technical
reasons and the goods or services can be supplied only by a
particular supplier and no alternative or substitute exists;"
4. Government Contracts Regulations Exception
This contract is subject to subsection 6 (d) of the Government
Contracts Regulations, in that only one person or company is
capable of performing the contract.

8. Submission of Statement of Capabilities by Suppliers
Suppliers who consider themselves fully qualified and available
to provide the goods described herein, may submit a statement of
capabilities in writing to the contact person identified in this
Notice on or before the closing date of this Notice. The
statement of capabilities must clearly demonstrate how the
supplier meets the advertised requirements. Proof of unit
testing or deployment on a shorebird species, specifically
sandpipers or plovers will be required in the statement of
capabilities. Acceptable proof will include published studies or
through references (name/contact information must be supplied).
The PWGSC file number, the contracting officer's name and the
closing date of the ACAN must appear on the outside of the
envelope in block letters or, in the case of a facsimile
transmission, on the covering page.
The Crown retains the right to negotiate with suppliers on any
procurement.
Documents may be submitted in either official language of Canada.
