Correctional Service of Canada has a requirement for the
provision of services as specified under "Background" below. The
purpose of this Advance Contract Award Notice (ACAN) is to
signal the government's intention to award a contract for these
services to Regional Health Authority B, Moncton, New Brunswick.
Before awarding a contract, however, the government would like
to provide other suppliers with the opportunity to demonstrate
that they are capable of satisfying the requirements set out in
this Notice, by submitting a statement of capabilities during
the 15 calendar day posting period.
If other potential suppliers submit a statement of capabilities
during the 15 calendar day posting period that meet the
requirements set out in the ACAN, the government will proceed to
a full tendering process on either the government's electronic
tendering service or through traditional means, in order to
award the contract.
If no other supplier submits, on or before the closing date, a
statement of capabilities meeting the requirements set out in
the ACAN, a contract will be awarded to the pre-selected
supplier.
Background
The Department of Correctional Services of Canada has a
requirement to provide noon meals to Correctional Officers from
Dorchester Penitentiary assigned to work the Secure Unit at the
Moncton Hospital, on an as required and when required basis.
The proposed contract is for a period of 3 years, from November
1, 2012 to October 31, 2013 with an irrevocable option on the
part of Canada to extend the period of any resulting contract by
up to 2 additional 1 year periods.
The estimated value of the contract, including the option
periods, is $67,800.00 (HST included).
Minimum Essential Requirements
Any interested supplier must demonstrate by way of a statement
of capabilities that it meets the following requirements:
1) The contractor must be capable of providing a variety of
noon meals to Correctional Officers on-site at the Moncton
Hospital within the established maximum of $15.00 per meal.
Justification for the Pre-Selected Supplier
The requirement to have security escorts for inmates
hospitalized in outside hospital is the law and CSC has very
clear regulations relative to the type of escort and required
number of officers.
The secure unit for CSC in the Atlantic Region is at the Moncton
Hospital. The services must be provided at the hospital, as the
officers are not permitted to leave the premises when providing
a security escort. As there is no place for the officers to
store food, provision have been made for access to food through
the hospital cafeteria.

and the North American Free Trade Agreement (NAFTA); however,
limited tendering reasons are applicable in accordance with the
following:

being invoked in this procurement as only one person or firm is
capable of performing the contract.

limited tendering due to where there is an absence of
competition for technical reasons and the goods or services can
