1. An ACAN is a public notice indicating to the supplier
community that a department or agency intends to award a
contract for goods, services or construction to a pre-identified
supplier, thereby allowing other suppliers to signal their
interest in bidding, by submitting a statement of capabilities.
If no supplier submits a statement of capabilities that meets
the requirements set out in the ACAN, on or before the closing
date stated in the ACAN, the contracting officer may then
proceed with the award to the pre-identified supplier.

2. Natural Resources Canada (NRCan), Analytical Services Group
(ASG) at CanmetMINING (CMIN), has a requirement to purchase an
Inductively Coupled Plasma Mass Spectrometer.

3. Minimum Essential Requirements

Any interested supplier must demonstrate by way of a statement
of capabilities that its system meets the following requirements:

A. Triple quadrupole system with a resolution of 1 atomic mass
unit (amu) prior to the reaction collision cell.

B: Guaranteed abundance sensitivity of 10-10:

C: Tandem ICP-MS/MS configuration offering various modes of
operation.

D: Software driven aerosol dilution

E: Guaranteed instrumental limit of detection of 0.05 ppt for
In and U and 0.1 ppt for Be.

F: Background of 0.2 cps on m/z 9 and 238.

G: Long term stability over a 2 hour period of less than 4%.

4. Applicability of the trade agreement(s) to the procurement

This procurement is subject to the following trade
agreement(s):

Agreement on Internal Trade (AIT)
North American Free Trade Agreement (NAFTA)
World Trade Organization (WTO)

5. Comprehensive Land Claims Agreement(s)

Not Applicable.

6. Justification for the Pre-Identified Supplier

The Agilent 8800x QQQ ICP-MS offered by Agilent has been
selected for the following reasons:

  • The Agilent 8800x QQQ ICP-MS by definition #538 from the

International Union of Pure and Applied Chemistry IUPAC is a
triple quadrupole system comprised of two quadrupole mass
spectrometers Q1 and Q2 in series, both having unit mass
resolution (1 amu m/z), with a non-selecting RF-only quadrupole
or multipole between them to act as a reaction collision cell.
It is the only instrument in the world with this patented
ICP-MS/MS configuration.

  • The Agilent 8800x is the only ICP-MS system that provides

predictable and controlled reactions with reactive cell gases
regardless of sample matrices because the first quadrupole (Q1)
operates under vacuum as a mass spectrometer with a 1 amu
resolution prior to the reaction collision cell. ASG requires
this ability as it is supporting multiple projects at CMIN by
analyzing their samples containing rare earth elements (REEs) at
% to ppm levels in various mineralogies.

  • The Agilent 8800x has a guaranteed abundance sensitivity of

10-10 based on 133Cs+. Instruments with higher abundance
sensitivity (10-6 or 10-7) are prone to yield high biased
results caused by contributions from high intensity signals of
co-existing ions onto neighbouring analyte ions such as high
concentrations of 138Ba+ or 140Ce+ "spilling" onto 139La+ or
141Pr, respectively. ASG needs this capability as it is
supporting the Canadian mining industry by analyzing samples
from research projects involving the purification, concentration
and separation of REEs.

  • The Agilent 8800x QQQ ICP-MS is the only instrument with the

ability to do precursor and/or product ion scans by operating
either quadrupoles in a fixed mass mode (i.e. 151 m/z only) or
in a scanning mode over a specified mass range (152 to 160 m/z).
It is also the only instrument supporting up to four (4)
separate cell gases which are independently mass flow
controlled, can be mixed in-line and used in sequence, during
the same analytical run. ASG requires these abilities for
method development to provide accurate and precise concentration
values for the verification of "in-production" certified
reference materials (CRMs) containing % to ppm REE levels for
the Canadian Certified Reference Material Project (CCRMP) and
for pre-releasing samples to participating labs containing
various REE concentrations for the Proficiency Testing Program
for Mineral Analysis Laboratories (PTP-MAL). Both CCRMP and
PTP-MAL are part of CMIN and internal clients of ASG.

  • The Agilent 8800x has a patented high matrix tolerance

introduction system located between the spray chamber and the
torch. It functions by delivering a precisely controlled amount
of Argon to obtain uniform aerosol dilution. This unique
capability results in a hotter plasma and decreased polyatomic
ions thereby reducing the amount of interferences. ASG requires
this ability for analyzing samples with high total dissolved
solids such as seawater and post fusion liquids for REEs.

7. Government Contracts Regulations Exception(s)

10.2 Exceptions 10.2.1 Section 6 of the Government Contracts
Regulations contains four exceptions that permit the contracting
authority to set aside the requirement to solicit bids.

These are:

a. the need is one of pressing emergency in which delay would
be injurious to the public interest;

b. the estimated expenditure does not exceed $25,000,
$100,000, where the contract is for the acquisition of
architectural, engineering and other services required in
respect of the planning, design, preparation or supervision of
the construction, repair, renovation or restoration of a work,
or $100,000 where the contract is to be entered into by the
member of the Queen's Privy Council for Canada responsible for
the Canadian International Development Agency and is for the
acquisition of architectural, engineering or other services
required in respect of the planning, design, preparation or
supervision of an international development assistance program
or project;

c. the nature of the work is such that it would not be in the
public interest to solicit bids;

OR

d. only one person or firm is capable of performing the
contract.

The following exception to the Government Contracts Regulations
is invoked for this procurement under subsection 10.2 Section
6(d) - "only one person is capable of performing the work").
