1.Advance Contract Award Notice (ACAN)
An ACAN is a public notice indicating to the supplier community that a department or agency intends to award a contract for goods, services or construction to a pre-identified supplier, thereby allowing other suppliers to signal their interest in bidding, by submitting a statement of capabilities. If no supplier submits a statement of capabilities that meets the requirements set out in the ACAN, on or before the closing date stated in the ACAN, the contracting officer may then proceed with the award to the pre-identified supplier.
2.Definition of the Requirement
The Product Safety Laboratory (PSL) at Health Canada has a requirement for the supply of a Portable Raman Spectrometer including all hardware and software, accessories and peripherals, cabling and components, and 1 year warranty including maintenance and support services. The instrument will be used to screen for chemical hazards in consumer products, cosmetics, and vaping products to support risk assessment activities, and to develop and validate new test methods. The instrument must be handheld with high sensitivity and resolution (e.g. determination of fentanyl in psychoactive substances), and have through-barrier analysis capabilities (ability to test opaque packaging materials and containers). The through-barrier analysis capabilities must test through sealed containers, such as colored and opaque plastics, glass, paper, wrapping, sacks, and fabrics without the need for sampling.
3.Criteria for assessment of the Statement of Capabilities (Minimum Essential Requirements)
Any interested supplier must demonstrate by way of a statement of capabilities that its instrument meets all of the following requirements:
The instrument must be a handheld Raman Spectrometer (hereinafter referred to as the spectrometer) which must meet all of the following specifications:
- The spectrometer must include an 830nm laser source with adjustable power (450 mW or higher);
- The spectrometer must test samples directly (i.e. point and shoot); through transparent, non-metallic packaging and containers; and through opaque, non-metallic packaging and containers (i.e. through-barrier analysis);
- The spectrometer must work with a rechargeable Li ion battery;
- The spectrometer must weigh (including the battery) less than or equal to 2.5kg;
- The spectrometer must be resistant to shock, drop, vibration, and water damage;
- The spectrometer must include USB connectivity and software options to export digital data files for offline analysis; and
- The spectrometer must identify chemicals concealed behind barriers such as coloured and opaque plastics, dark glass, paper and fabric. The scans through barriers must be 60 seconds or shorter.
4.Applicability of the trade agreement to the procurement
This procurement is subject to the following trade agreement:
- Canadian Free Trade Agreement (CFTA)
5.Justification for the Pre-Identified Supplier
The Portable Raman Spectrometer equipped with the Spatially Offset Raman Spectroscopy (SORS) is the only known instrument that meets all of the minimum essential requirements listed in Section 3 above. Agilent Technologies Canada is the original equipment manufacturer (OEM) of this instrument, owner of all related Intellectual Property and is the only known supplier that can supply an instrument meeting all of the minimum essential requirements listed in Section 3 above.
6.Government Contracts Regulations Exception
The following exception to the Government Contracts Regulations is invoked for this procurement under subsection 6(d) - only one person is capable of performing the work.
7.Exclusions and/or Limited Tendering Reasons
The following exclusion and/or limited tendering reasons are invoked:
- Canadian Free Trade Agreement (CFTA) - Article 513.1(iii)
8.Period of the proposed contract or delivery date
The instrument must be delivered on or before March 31, 2021.
9.Name and address of the pre-identified supplier

An Advance Contract Award Notice (ACAN) allows departments and agencies to post a notice, for no less than fifteen (15) calendar days, indicating to the supplier community that it intends to award a good, service or construction contract to a pre-identified contractor. If no other supplier submits, on or before the closing date, a Statement of Capabilities that meets the requirements set out in the ACAN, the contracting authority may then proceed with the award. However, should a Statement of Capabilities be found to meet the requirements set out in the ACAN, then the contracting authority will proceed to a full tendering process.
Suppliers who consider themselves fully qualified and available to provide the services/goods described herein, may submit a statement of capabilities in writing to the contact person identified in this Notice on or before the closing date of this Notice.
