1. Advance Contract Award Notice (ACAN)

An ACAN is a public notice indicating to the suppliercommunity that a department or agency intends to award a contract for goods, services or construction to a pre-identified supplier, thereby allowing other suppliers to signal their interest in bidding, by submitting a statement of capabilities. If no supplier submits a statement of capabilities that meets the requirements set out in the ACAN, on or before the closing date stated in the ACAN, the contracting officer may then proceed with the award to the pre-identified supplier.

2. Definition of the requirement

The Department of the Environment (Environment and Climate Change Canada (ECCC)) has a requirement to develop a naphthenic acid primary standard prevalent in natural bitumen-influenced waters and industrial process waters in the Athabasca oil sands region. The standard is required for analytical method development of naphthenic acids measurements in monitoring programs for the oil sands region of Alberta.

The work will involve the following:

Conduct multi-step custom organic synthesis for Family A isomer. Synthesize isotopically labelled analogue, as required. Conduct spectral characterizations for structural confirmations of final products.

3. Criteria for assessment of the Statement of Capabilities (Minimum Essential Requirements)

Any interested supplier must demonstrate by way of a statement of capabilities that it meets the following requirements:

3.1 Experience:

Suppliers must have a minimum of 10 years of experience from the ACAN closing date in the following:

3.1.1 Experience in custom organic syntheses;
3.1.2 Experience in naphthenic acid custom synthesis;
3.1.3 Experience in isotopic labelling in custom syntheses;
3.1.4 Experience in other synthetic fields potentially applicable to naphthenic acids such as agrochemicals and pharmaceuticals custom synthesis;
3.1.5 Experience in preparative custom syntheses;
3.1.6 Experience and qualifications in handling potential steroid precursors.

3.2 Knowledge and understanding of:

Suppliers must have a knowledge and understanding of the following areas, which must be demonstrable by scientific publications in each area in the primary peer-reviewed scientific literature or in previous synthetic contracts performed for other clients:

3.2.1 Naphthenic acid structures, custom synthesis;
3.2.2 Multiple, alternate synthetic routes used in naphthenic acid syntheses;
3.2.3 State of the art spectroscopy techniques to confirm structural assignments;
3.2.4 Purification techniques to achieve desired product quality specifications;
3.2.5 Isotopic labelling in synthetic routes as applicable to naphthenic acids; and
3.2.6 Pharmaceuticals and agrochemicals;

3.3 Academic qualifications:

3.3.1 The proposed resources must be syntheticdesigners and must possess doctoral degree from a recognized university in the field of organic synthesis;

3.4 Professional designation, accreditation, and/or certification:

3.4.1 The supplier must possess laboratory accreditations to conduct syntheses and assign structural properties and purity specifications, authorizations to handle steroids potentially used as precursors proposed resources must;

3.4.2 The suppliers proposed resources must be PhD organic chemists designing and conducting syntheses.

4. Applicability of the trade agreement(s) to the procurement

This procurement is subject to the following trade agreements:

o Agreement on Internal Trade (AIT)
o North American Free Trade Agreement (NAFTA)

5. Justification for the Pre-Identified Supplier

The field of custom organic synthesis is restricted, and within this sector, there are specializations for classes of compounds and synthetic routes. Snieckus Innovations, an academic unit within Queens University is the only known supplier that can perform the work as they have a long history of research in this area of synthesis and is considered a world authority on synthetic strategies in synthesis of poly-substituted aromatics. Sneickus Innovations has been a recognized authority on these types of organic syntheses for a number of years, as evidenced by their publications and patents in this field of organic syntheses. As such, it is uniquely qualified to conduct the synthesis that is required to meet ECCC’s requirement.

6. Government Contracts Regulations Exception(s)

The following exception(s) to the Government Contracts Regulations is (are) invoked for this procurement under subsection 6 (d) - "only one person is capable of performing the work."
