ADVANCED CONTRACT AWARD NOTICE
An ACAN is a public notice indicating to the supplier community
that a department or agency intends to award a contract for
goods, services or construction to a pre-identified supplier,
thereby allowing other suppliers to signal their interest in
bidding, by submitting a statement of capabilities. If no
supplier submits a statement of capabilities that meets the
requirements set out in the ACAN, on or before the closing date
stated in the ACAN, the contracting officer may then proceed
with the award to the pre-identified supplier.

DEFINITION OF THE REQUIREMENT

The Public Health Agency of Canada - National Microbiology
Laboratory has a requirement for the supply and
delivery/installation of a Particle Characterization System.

The National Microbiology Laboratory (NML) Electron Microscope
laboratory provides a service for all NML scientists. NML
endeavors to provide images of the various pathogens being
investigated. At present the facility has two electron
microscopes, a transmission electron microscope, and scanning
electron microscope. These microscopes are used to image
viruses, bacteria, and tissue culture cells which have been
infected with a pathogen. The particle characterization system
required will be used to access the heterogeneity of biological
samples being imaged, and calculate particle concentration. As
well, the system will be used to access biological reactions
such as virus - liposome fusion and the ability of various
reagents to impede this key process in viral attachment and
penetration into the host cell. This will provide fundamental
information for the development of vaccines and antivirals. The
system must meet all of the essential requirements listed below.

MINIMUM ESSENTIAL REQUIREMENTS

Any interested supplier must demonstrate by way of a statement
of capabilities that its product meets the following
requirements:
Item Description
1 The system will be used for heterogeneous biological samples,
the system must be able to differentiate and identify particles
in a liquid suspension that contains particles of different
sizes. Particle detection range must at least encompass the size
range of 30 nm -1um.
2 Unknown biological samples/fluids will be processed; the
chemical or biological composition of the fluids will be
unknown. The system must not need to know anything about the
liquid being analyzed (eg. refractive index or particle density
information) in order to determine the size distribution of the
samples being analyzed.
3 The system must be able measure particle concentration.
4 The system must operate on standard North American voltage
(110 V AC).
5 The system must include one PC, with pre-loaded software to
operate the particle counter, and also include a flat screen
monitor, that is 22" or larger
6 The system must use a CMOS (Complementary
Metal-Oxide-Semiconductor) high sensitivity camera to detect
particles. (i.e. not a CCD [charge coupled device] camera)
7 The system must have fluorescent filters to detect and image
fluorescent labeled samples.
8 The system must have temperature control with a sensitivity of
0.5oC or better
9 The system must use peristaltic pumps controlled by the system
software.
10 The system must have at least one syringe pump controlled by
the system software.
11 The system must include a color laser printer.
12 The system must be able to measure particles at
concentrations as low as 107 particles / ml or lower.
13 Minimum OEM Warranty - 1 year

JUSTIFICATION FOR THE PRE-IDENTIFIED SUPPLIER

The Nanosight system is a unique piece of equipment, in both its
methodology (ability to detect particles in heterogeneous
samples) and their level of automation. Various equipment from
alternate suppliers was evaluated and none could match all the
minimal essential requirements detailed above.

Diagnostics: The "diagnostic capacity" will be used to identify
unknown samples that arrive at the laboratory. To date electron
microscopy has been used for identification in the diagnostic
microscopy laboratory. The equipment being requested will
provide a rapid complementary method to screen samples. In this
instance the equipment will analyze the sample for size
distribution to identify the presence of particles of a specific
size range. This data will assist the electron microscopy
analysis by indicating the presence of a particle (putative
virus) of a specific size range in the diagnostic sample being
processed.

Research & Development: Several activities fall under this type
of work done in the lab ranging from; virus like particle
production, development of antivirals, working with
fluorescently labeled viruses and vesicles, and the
investigation of virus-host interactions using a vesicle based
system which includes virus host cell fusion and the effect of
temperature, pH, and enzymatic cleavage/processing of the viral
spike necessary for spike-receptor binding. In all the above
cases the "Particle Characterization System" being requested
will be essential in the research and development process to
study these dynamic systems. This "Particle Characterization
System" will provide "real time" bio-physical kinetic data on
these projects that we currently are not able to do. With this
equipment NML will be able to study in "real time" virus host
fusion, characterize this, and then measure the effects of
antiviral agents on this process.

Regulations is (are) invoked for this procurement under
subsection: Government Contract Regulations, Part 1, Section
6(d) only one supplier (person or firm) is capable of performing
the contract.

there is an absence of competition for technical reasons and the
goods or services can be supplied only by a particular supplier
and no alternative or substitute exist.

North American Free Trade Agreement (NAFTA) - Article 1016 - 2
(b) where, for works of art, or for reasons connected with the
protection of patents, copyrights or other exclusive rights, or
proprietary information or where there is an absence of
competition for technical reasons, the goods or services can be
supplied only by a particular supplier and no reasonable
alternative or substitute exists.

Canada - Chile Free Trade Agreement (CCFTA) - Article Kbis-09 -
1(b) where, for works of art, or for reasons connected with
protection of patents, copyrights or other exclusive rights, or
proprietary information, or where there is an absence of
competition for technical reasons, the goods or services can be
supplied only by a particular supplier and no reasonable
alternative or substitute exists.

Canada - Peru Free Trade Agreement (CPFTA) - Article 1409 1(b)
where the goods or services can be supplied only by a particular
supplier and no reasonable alternative or substitute goods or
services exist for any of the following reasons:
(i) the requirement is for a work of art,
(ii) the protection of patents, copyrights or other exclusive
rights, or
(iii) due to an absence of competition for technical reasons;

Canada - Columbia Free Trade Agreement (CCFTA) - Article 1409
1(b)Where the goods or services can be supplied only by a
particular supplier and no reasonable alternative or substitute
goods or services exist for any of the following reasons:

i.The requirement is for a work of art,
ii.The protection of patents, copyrights or other exclusive

described in the ACAN may submit a statement of capabilities in
writing to the contact person identified in this notice on or
before the closing date of this notice. The statement of
capabilities must clearly demonstrate how the supplier meets the
advertised requirements.

CLOSING DATE FOR A SUBMISSION OF A STATEMENT OF CAPABILITIES

The closing date and time for accepting statements of
capabilities is:Friday. Dec. 6, 2013 .

An Advance Contract Award Notice (ACAN) allows departments and
agencies to post a notice, for no less than fifteen (15)
calendar days, indicating to the supplier community that it
intends to award a good, service or construction contract to a
pre-identified contractor. If no other supplier submits, on or
before the closing date, a Statement of Capabilities that meets
the requirements set out in the ACAN, the contracting authority
may then proceed with the award. However, should a Statement of
Capabilities be found to meet the requirements set out in the
ACAN, then the contracting authority will proceed to a full
tendering process.

The Crown retains the right to negotiate with suppliers on any
procurement.
