1. Advance Contract Award Notice (ACAN)
An ACAN is a public notice indicating to the supplier community that a department or agency intends to award a contract for goods, services or construction to a pre-identified supplier, thereby allowing other suppliers to signal their interest in bidding, by submitting a statement of capabilities.
If no other supplier submits, on or before the closing date, a statement of capabilities that meets the requirements set out in the ACAN, the competitive requirements of the government’s contracting policy have been met.
Following notification to suppliers not successful in demonstrating that their statement of capabilities meets the requirements set out in the ACAN, the contract may then be awarded using the Treasury Board electronic bidding authorities.
If other potential suppliers submit statements of capabilities during the fifteen calendar days posting period, and meet the requirements set out in the ACAN, the department or agency must proceed to a full tendering process on either the government’s electronic tendering service or through traditional means, in order to award the contract.

2. Definition of Requirements
Transport Canada intends to award a contract to the Commercial Vehicle Safety Alliance (CVSA) to host, maintain and develop the web platform that is home of North American Fatigue Management Program (https://nafmp.org/). The responsibility for these tasks will be assigned to a fatigue management expert, who will also actively promote and disseminate the program to increase its use within the motor carrier industry and actively support motor carriers and industry associations as they implement it.

The key requirements for this contract are: hosting, maintaining and updating the interactive website of the NAFMP, responding to user’s requests, addressing technical issues, providing comprehensive quarterly website usage data to the Steering Committee (SC), and conducting coordinated outreach and training activities to support program adoption.

3. Criteria for Assessment of the Statement of Capabilities
Suppliers must clearly demonstrate, in their statement of capabilities, that they meet all of the following mandatory requirements. Failure to demonstrate any of these requirements will result in the submission being considered non-responsive.

3.1 Integrated Program Delivery Capability
The supplier must demonstrate the ability to deliver an integrated solution that combines:

• Hosting, maintenance, and ongoing development of a publicly accessible web platform in both official languages for 16,000+ users; and
• Delivery and administration of online training content through a Learning Management System (LMS); and
• Ongoing user support, including responding to technical inquiries and resolving issues in a timely manner.

3.2. Experience Delivering Large-Scale Safety and Behavioral Programs to the motor carrier industry
The supplier must be a safety-oriented organization with access to representatives from all the sectors of the motor carrier industry in North-America and demonstrate experience in delivering and supporting large-scale, non-regulatory safety and behavioral programs to the motor carrier industry, including:

• Outreach, education, and engagement with multiple stakeholder groups; and
• Supporting adoption and implementation of program tools and guidance materials by end users.

3.3 North American Stakeholder Engagement Capacity
The supplier must demonstrate experience in engaging and communicating effectively with a broad network of stakeholders across North America ( Canada, United States and Mexico), including:

• Over 10,000 members from the Commercial vehicle enforcement community;
• Over 500 members from the motor carrier industry (e.g., carriers, drivers, industry associations); and
• Government and regulatory agencies responsible for enforcing the motor carrier regulatory framework.

This includes the ability to conduct coordinated outreach activities across multiple jurisdictions in both official languages.
3.4 Outreach and Knowledge Mobilization Capability
The supplier must demonstrate established and effective mechanisms to:

• Promote program awareness and adoption through multiple communication channels (e.g., digital platforms, events, publications, and stakeholder networks);
• Disseminate and implement training materials and educational content at scale; and
• Collect, analyze, and report on stakeholder feedback to support continuous program improvement.

3.5 Subject Matter Expertise
The supplier must demonstrate full-time access to qualified subject matter expertise in fatigue management and related areas of commercial vehicle safety sufficient to:

• Support fatigue management program delivery;
• Engage with stakeholders; and
• Provide informed recommendations for program improvements.

3.6 Data Collection, Reporting, and Performance Monitoring
The supplier must demonstrate the ability to:

• Monitor and report on program usage and performance metrics;
• Provide regular analytical reports, including user engagement, training participation, and system usage such as:

? Number of users;
? Website traffic (e.g., page views);
? Geographic distribution of users;
? Device types used to access the website;
? Social media or referral sources;
? Number of downloads of training materials by format;
? Training metrics, including:
? Number of users enrolled;
? Participation in training modules;
? Average scores per training module.

• Use data and stakeholder feedback to support evidence-based recommendations for program enhancements.

3.7. Technical and Operational Requirements
The supplier must demonstrate the ability to:

• Provide reliable and secure website hosting services, including ongoing maintenance and updates, on a quarterly basis.
• Ensure accessibility of bilingual content (English and French);
• Maintain availability of training materials in multiple formats, including LMS-based delivery;
• Provide ongoing technical support to users 24/7 and
• Ensure compliance with applicable information technology security and accessibility standards.

3.8. Program Continuity and Transition Capability
The supplier must demonstrate the ability to:

• Maintain continuity of an established program with an existing binational user base and training ecosystem; and
• Support transition activities, including transfer of data, content, and systems, if required at the end of the contract period.

3.9. Multi-Jurisdictional Coordination
The supplier must demonstrate experience working in a multi-jurisdictional and international environment, including the ability to:

• Coordinate activities across multiple jurisdictions; and
• Support governance structures involving multiple governmental and institutional partners.

5. Justification for Pre-Identified Supplier
The Department is publishing this Advance Contract Award Notice (ACAN) in accordance with the Government of Canada’s contracting policy, which permits non-competitive procurement where there is an absence of competition for technical reasons.
Based on market analysis and program requirements, Transport Canada has not identified any alternative supplier that can demonstrate the capacity to meet the full scope of technical, operational, and cross-jurisdictional requirements associated with the North American Fatigue Management Program (NAFMP). This determination is based on knowledge of the supplier community, prior program delivery experience, and an assessment of available capabilities.
The NAFMP is a binational program jointly supported by Transport Canada and the United States Federal Motor Carrier Safety Administration (FMCSA). The program requires a contractor capable of supporting continuity of service across both jurisdictions, including coordination with existing governance structures, stakeholders, and program delivery mechanisms. The United States is currently pursuing a parallel contractual arrangement with the same organization in order to maintain a consistent and aligned delivery model across North America.
The requirement is not limited to the provision of website hosting services. Rather, it involves the integrated delivery of a mature and established program that combines:

• Ongoing maintenance and enhancement of an existing web platform and associated tools;
• Delivery and management of structured training through a Learning Management System;
• Provision of technical support to a distributed user base; and
• Active promotion, outreach, and stakeholder engagement to support adoption and implementation of the program across the motor carrier industry and enforcement communities.

The requirement also involves maintaining continuity of an established program with an existing user base, training ecosystem, and operational framework. Transitioning this program to an alternative supplier would introduce significant risks, including disruption to program delivery, loss of stakeholder engagement, and potential impacts on binational coordination and program effectiveness.
Based on these considerations, Transport Canada has determined that no alternative supplier has been identified that can meet all of the requirements without introducing unacceptable technical, operational, and program continuity risks. As such, the proposed supplier has been identified as the only known supplier identified through this process as capable of fulfilling the requirement.

7. Ownership of Intellectual Property
Ownership of any Foreground Intellectual Property arising out of the proposed contract will vest in NAFMP.
8. Contract Period
The proposed contract period will be from September 1, 2026, to August 31, 2031.

9. Estimated Cost
The estimated maximum value of the proposed contract is $662,000 (USD) ($915,810.00 CAD), including applicable taxes.

11. Suppliers’ Right to Submit a Statement of Capabilities
Suppliers who consider themselves fully qualified and available to provide the services/goods described herein, may submit a Statement of Capabilities in writing, preferably by e-mail, to the contact person identified in this Notice on or before the closing date and time of this Notice. The Statement of Capabilities must clearly demonstrate how the supplier meets the advertised requirements.
Responses received on or before the closing date will be considered solely for the purpose of deciding whether or not to conduct a competitive procurement. Information provided will be used by the Crown for technical evaluation purposes only and is not to be construed as a competitive solicitation. Your written response must provide sufficient evidence (e.g. specifications, technical data, drawings, or any other proof) that clearly demonstrates that your product or service is capable of fulfilling this requirement.
Suppliers that have submitted a response will be notified in writing of TC’s decision to continue with the non-competitive procurement or to compete for the requirement
